Crewed yacht charter terms explained.

There are various terms used when fully crewed yachts are offered for charter, the most common are explained below:

The Charter Agreement - Most fully crewed charter yachts use a charter agreement sponsored by MYBA (Mediterranean Yacht Brokers Association) and adopted by CYBA (Charter Yacht Brokers Association) and AYCA (American Yacht Charter Association). The agreement specifies the particulars of the charter, payment schedules, cancellation policies and defines the rights and obligations of all parties in contingencies. Although the charter agreement might seem daunting at first, it is relatively simple especially considering you are taking charge of someone's multi-million Euro investment. Make sure that you understand the terms and provisions of the charter agreement.

Charter Rate - Rates for charter yachts may vary according to the season, the number of charter guests, and the region in which the yacht is operating. Items that are included in the charter rate and items that are additional expenses and fees vary according to the terms under which the yacht operates. The charter agreement clearly defines the terms and the charter rate. Please note that rates in this web site are subject to change without notice until the booking is confirmed.

Fees and Expenses -

It is important from the outset to understand the terms and conditions under which charter yachts operate as well as what additional fees and expenses may be incurred on your charter. This will allow you to have a realistic assessment of your budget needs and to compare value when researching your vacation options. If there are any items you do not understand please ask us for clarification.

Operating Expenses - Crewed charter yachts include different items in their rate depending on their type, size and the cruising area. The operating expenses (food, fuel, etc.) included or not included are determined by the operating "terms" under which a yacht is chartered. Following is a simple explanation of the common terms. The operating terms for most yachts fall into two general categories; "plus all expenses" (MYBA terms) and "inclusive" (CTI). For yachts operating under inclusive terms the meals and many operating expenses are included. Beverages are often not included but may be for some yachts. For Motor yachts operating under plus all expenses terms, a general rule for estimating expenses is to add on an additional 20% to 30% of the base charter rate. Sailing yacht expenses are generally less than those for Motor yachts.

"Plus all expenses" Explained - When exploring luxury yacht charters for the first time one often hears the charter rate referred to as "plus all expenses". At first glance the fact that almost every item a guest will consume is an extra cost may raise an eyebrow. However, plus all expense terms are common on the larger yachts and serve to ensure that every item of your holiday is crafted to your specifications and delivered at a good value. Food and beverage provisions are custom ordered according to your direction. You select the expense level. Fuel is charged on consumption. You pay for what you use. You are free to be as extravagant as you choose. After all it is your holiday and you live it according to your budget and tastes, not someone else's. Also remember, expenses are charged to you at cost to the yacht. There is no markup. When you think about it, plus all expenses is an excellent system for a luxury yachting vacation.

Advance Provisioning Allowance (APA) - When chartering a yacht under plus all expenses terms an Advance Provisioning Allowance of 20%-25% of the charter fee is sent to the yacht ahead of time. These funds are used to provision the yacht according to your preferences. The Captain will advise you periodically as to the disbursement of the APA. Prior to disembarkation at the end of the charter, the Captain shall present a detailed account of expenditure. The Captain shall return any unused funds in cash. Should the APA balance become insufficient during the cruise, you will be expected to pay to the Captain in cash a sufficient sum to maintain an adequate balance.

Taxes and Harbour Fees - Most countries and island nations impose some type of cruising tax or harbor fees on charter yachts. These expenses are for the account of the charter guest but are usually only a small item in the charter budget. An exception would be the VAT imposed by European Union nations. VAT can vary between 16% and 23% of the charter fee. Not all yachts are subject to VAT. Specifics of VAT will be discussed directly with you in situations where it might be applicable.

Gratuities - Customary crew gratuity is 10%-20% of the charter fee based on service received and at your discretion. The gratuity should be handed to the Captain for distribution to the crewmembers

Operating Terms - The "terms" under which a yacht operates, and lays out what items are, or are not, included in the charter rate.

Western Mediterranean Terms ( WMT ) - often referred to as "MYBA terms" (Mediterranean Yacht Brokers Association). Under WMT ( OR MYBA) terms the charter fee includes charter of the yacht and equipment, crew wages and food, ship's laundry, basic operating consumables, and insurance of the yacht for marine risk, third party claims, and the crew for employer's liability insurance. The charterer will be charged extra, and at cost to the yacht, for all other expenses. These expenses include food and all beverages for the charter guests, fuel for the yacht and auxiliary craft, dockage, VAT if applicable, taxes, harbor fees, communications, guest laundry and shore-side electricity and water. Most Superyachts and larger luxury crewed charter yachts operate under MYBA terms at all times and in any region. Yachts of all sizes chartering outside of the Caribbean, especially in the Mediterranean, will usually operate on a MYBA terms basis. Caribbean Terms Inclusive ( CTI ) - For yachts operating under CTI, sometimes referred to as SCT (Standard Caribbean Terms), the charter fee includes all items on the MYBA terms plus three meals per day and fuel for four hours' cruising daily averaged over the charter. Some yachts operating under Caribbean Terms include all beverages except vintage wines and champagnes. With the exception of most Superyachts and larger crewed charter yachts, most crewed charter yachts in the Caribbean operate under CTI. Eastern Mediterranean Terms ( EMT ) - The charter fee includes charter of the yacht and equipment, crew wages and food, ship's laundry, basic operating consumables, fuel for four hours' cruising daily averaged over the charter, breakfast and lunch, and insurance of the yacht for marine risk, third party claims, and the crew for employer's liability insurance.The charterer will be charged extra, and at cost to the yacht, for all other expenses. These expenses include dinners if taken aboard and all beverages for the charter guests, additional fuel for the yacht and auxiliary craft, dockage, VAT if applicable, taxes, harbor fees, communications, guest laundry and shore-side electricity and water. Gulet Terms - As above, but excludes breakfast & lunch, which is provided at an additional fixed price per person Greek Terms ( GT ) - The charter fee includes charter of the yacht and equipment, crew wages and food, ship's laundry, basic operating consumables, water, harbor dues within Greek waters, and insurance of the yacht for marine risk, third party claims, and the crew for employer's liability insurance. The charterer will be charged extra, and at cost to the yacht, for all other expenses. These expenses include food and all beverages for the charter guests, fuel for the yacht and auxiliary craft, dockage, VAT if applicable, taxes, communications, guest laundry and shore-side electricity.

Below is a general guide to the types of contracts, terms and conditions used for luxury yacht charters including what is and isn’t included in your yacht charter.

Charter yacht rates may vary according to the season, peak charter periods, special events and holidays, the number of charter guests, and the region in which the yacht is operating. The charter agreement will clearly define the terms and the charter rate. Items that are included in the charter rate and items that are additional vary according to the terms under which the yacht operates.

There are two main types of luxury yacht charters – namely ‘all inclusive’ and ‘plus expenses’.

Most yachts based in the Eastern Mediterranean or Western Mediterranean , regardless of size will usually operate on a ‘plus expenses’ basis. Some smaller yachts based in the Caribbean , Bahamas or America year round use the ‘all-inclusive’ way of quoting however most of the larger superyachts that visit the Caribbean seasonally will always quote ‘plus expenses’ regardless of their location.

‘Plus expenses’

Yachts quoted as ‘plus expenses’ means that in addition to the charter fee, 25-35% of the charter fee will be collected as an Advanced Provisioning Allowance for expenses.   Provisioning and preparation is then done by the crew based upon your specific preferences. Food and beverage provisions are custom ordered, charged at cost price. Fuel is also charged on consumption. The benefit of paying for expenses additionally is that you have more control over your costs and you only pay for what is ordered.

The ‘Advanced Provisioning Allowance’ (APA): The Advanced Provisioning Allowance is collected with your final payment and is forwarded onto the Captain in order to prepare for your charter. The APA is estimated at between 20 and 35% of the charter fee depending on the yacht and the charter location.  The final expenses may be more or less depending on your individual requirements.  The captain will be responsible for the accounting of your expenses; he will advise you periodically as to the disbursement of the APA and will provide receipts at the end of the charter.  Should you spend more than your estimated expense allowance, say by ordering unusually expensive items, staying in expensive ports or doing excessive cruising, additional payment will be required during your charter. Conversely, unspent APA will be refunded to you at the end.

‘Plus expenses’ terms are also known as WMT (Western Mediterranean Terms) and are often referred to as "MYBA terms" (Mediterranean Yacht Brokers Association). Under MYBA terms the charter fee includes charter of the yacht and equipment, crew wages and food, ship's laundry, basic operating consumables, and insurance of the yacht for marine risk, third party claims, and the crew for employer's liability insurance.

The charterer will be charged, at cost, for all other expenses. These expenses include but are not limited to food and beverages for the charter guests, fuel for the yacht and auxiliary craft, dockage, VAT if applicable, taxes, harbor fees, communications, guest laundry, shore-side electricity and water, onshore transfers and tours and anything else not specifically included in the charter fee.

Yachts chartering in the Eastern Mediterranean will usually use the MYBA contract or EMT (Eastern Mediterranean Terms) . The terms quoted can differ depending on the type of yacht (motor yacht sailing yacht or Gulet) and will also differ depending on the country. Under EMT or Turkish terms, rates can include costs such as fuel for four hours' cruising per day, local cruising taxes and local port fees . These yachts also tend to offer half or a full board menu options.

VAT - There is a VAT imposed by European Union nations. VAT can vary between 5.2% and 20% of the charter fee. Not all yachts are subject to VAT. Specifics of VAT will be discussed directly with you in situations where it might be applicable.

Gratuities – Crew gratuity is customary yet discretionary at 5%-20% of the charter fee based on service received. The recommended level varies depending on where the charter takes place.  Often higher gratuities are expected in the US and Caribbean than they are in the Mediterranean and other parts of the world.  The gratuity can be handed to the Captain for distribution to the crewmembers at the end of the charter or can be sent afterwards as a via wire transfer.

All inclusive Yacht Charters.

The charter rate for “All inclusive” yacht charters includes the fully equipped yacht, professional crew, fuel for up to 4 hours per day (in most cases), all meals and standard bar which basically means soft drinks, local beer & table wines. Some yachts also include basic spirits.  Extra costs would be for communication, dockage and mooring fees, cruising taxes, fine or exclusive wines and foods, airport transfers and anything else not specifically included in the charter fee. Crew gratuity is also customary but discretionary at 10-20% of the charter fee.

In the Caribbean, the ‘all inclusive’ contracts used are primarily the CYBA the (Charter Yacht Brokers Association).  AYCA the (American Yacht Charter Association), FYBA (Florida Yacht Brokers Association) are often used for charters in American waters and the MYBA - Mediterranean Yacht Brokers Association plus expenses terms are also widely used in the Caribbean for the larger yachts.

Charter yacht contracts, the different types of contracts used for fully crewed yachts, contracts used to book yachts.

Luxury yacht charters are reserved by use of a yacht charter contract. Once you have decided to plan and book a luxury yacht vacation at some point you will need to sign a yacht charter contract in order to book the yacht.

The Contracts - Between You And The Owner.

Your charter contract will be between you, the charterer, and the yacht's owner. The yacht's manager/representative will determine which type of contract is the correct one to be used based on your destinations, the yacht's certification in the country where it is registered, including if the yacht is certified as a private or commercial vessel, and other factors. Our specialist will prepare the charter contract for all parties to sign.

Types Of Charter Contracts Used.

There are a number of standard contracts used within the crewed yacht charter industry on a regular basis. The common types of contract are:

The MYBA charter contract, which was developed by the Mediterranean Yacht Brokers Association. This is probably the most used contract in the industry.

AYCA charter contracts, developed by the American Yacht Charter Association. There are two types of AYCA contracts; 'Uninspected' and the 'Bareboat/Services' which is a pair of agreements.

Caribbean term contracts, developed by the Charter Yacht Brokers Association.

What Is Covered By The Charter Contracts?

Regardless of what type of contract is used, each of them detail everything regarding the yacht, delivery, dates, prices, crew, number of guests, cancellation polices, safety, payment schedules, the responsibilities of the owner, charterer and captain, breakdowns, insurances, and many other details. They all have been developed and amended over many years to cover as many eventualities as possible.

Each of the charter contracts is a number of pages long and they are quite detailed. At first glance they can appear very complicated and daunting. Our specialists have used them all over many years and are very familiar with each of them, and are happy to discuss your questions and their understanding of the terms of each from a client's perspective.

These charter contracts are often for yachts which are worth millions of dollars and we advise all clients to be sure to read them carefully and to ask our specialists any questions that come to mind. Superyacht charter contracts explained

Once you have decided on chartering a yacht your broker will compile a contract which will detail the chosen charter yacht, cruise dates, intended destinations and cost.

The various contracts used by brokers can seem a little confusing but recently the various international charter organisations have started making the industry jargon easier to understand.

The two basic terms under which a yacht operates — which are spelled out in the contracts — are the Mediterranean Yacht Brokers Association (MYBA) terms and the Caribbean Terms Inclusive (CTI).

Mediterranean Yacht Brokers Association terms — “plus all expenses”

MYBA terms is best understood as a “plus all expenses” contract. Once called Western Med Terms (WMT), these are popular because the contract allows an “À la carte” approach to services. The concept of these terms evolved because most charterers in the Mediterranean eat ashore regularly, so unused food and beverages would be a waste of their money.

Basic charter fee includes:

  • the yacht and all its equipment from spa to water toys to entertainment systems
  • the crews wages and their food
  • the ship’s laundry
  • operating consumables
  • insurance coverage for the yacht and crew

Other expenses that will be charged to the charter at the cost paid with no markups:

  • food and beverages for the charter guests,
  • fuel for the yacht and tenders
  • harbour fees
  • communications
  • guest laundry
  • shore-side electricity

MYBA terms have proven to be fair to both the charterer and the yacht so most charter yachts operate on MYBA terms worldwide.

Caribbean Terms Inclusive — “mostly all-inclusive package”

CTI is sometimes known as Standard Caribbean Terms (SCT) and is best described as a “mostly all-inclusive package”.

As well as everything in the MBYT basic charter fee CTI terms also include:

  • Three meals per day for the charter guests
  • Four hours of cruising a day
  • Some beverages (some include a selection of standard bar liquors and wines, while others charge extra for all beverages).

Eastern Mediterranean Terms

EMT are still sometimes used, and these are the same as CTI terms, except they provide only breakfast and lunch on the assumption the charter guests will dine ashore in the evenings.

Non-disclosure agreement

Charter crews and charter brokers have a reputation for being discreet and highly protective about their charter clients. Nevertheless, depending upon who you are and your personal sense of privacy, a non-disclosure agreement won’t be seen as unusual. Whether you’re a celebrity who wants to avoid the paparazzi or a corporate executive carrying insider documents, such an agreement will serve to emphasise your need for privacy.

Use common sense

As with any contract — especially one involving a yacht worth millions — it’s common sense to read it carefully and ask your charter broker any questions that arise. It is even wiser to have your legal advisor review the contract and discuss it with your charter broker.

What are crewed yacht charters ?

Crewed yacht charters are the charter of a luxury yacht with your very own crew, who provide a range of services, including, but not limited to: -cooking meals tailored to your individual tastes (often world class chefs work on yachts) – offering beauty and massage services – chief stew whose role is to ensure your charter vacation has all of your needs met – laundry staff – service staff – dive instructors – toys experts (get the inflatables out and ensure everyone is having fun) – fitness instructors – yoga experts. The list of talent goes on.

Yacht Crew -They have a wealth of knowledge

Part chauffeur, part event-planner, part tour-guide… the life of a private yacht crew member is nothing if not varied. Yacht crews are carefully selected, highly skilled individuals who are there to ensure charterers get the most out of their yachting experience. Their role is multifaceted but generally includes:

  • Preparing high quality meals
  • Serving drinks
  • Cleaning: cabins, showers and bathrooms cleaned anytime you leave; deck spaces washed regularly)
  • Maintaining the yacht and keeping it safe
  • Assisting with water toys (Jet skis, Kayaks, Inflatables etc.)
  • Providing expertise based on insider knowledge
  • Planning ahead so you don’t have to
  • Entertaining children

  • It wouldn’t be uncommon for a gourmet burger to be requested at 3am!

However, for a crew with only one chef…

  • They might not deliver both a formal lunch and formal dinner.
  • So, it may be preferable to dine onshore once a day.

With a crew of two…

  • Approx. 8 guests could happily lounge away on a 20-metre yacht.
  • In this case, the captain is responsible for driving and safety. The second crew member has multiple roles: cleaner, steward, deckhand etc.
  • As they cannot do this all at once, making it clear what matters most to you is the key to a successful charter.

Before booking your charter, ask your broker:

  • What is the reputation of the charter yacht for hiring a good crew?
  • How many chefs there will be, and what their specialties are
  • If other crew members have any specialist skills (water sports, massages, personal training etc.)
  • For their combined years of experience
  • If there have been any complaints made against them
  • What is the reputation of the captain (a great captain has often been on the same yachts for years and a crew is only as good as the Captain that leads them)
  • To review crew members’ CV’s if you have any concerns

Remember, the crew knows the yacht owner’s standards, but not yours. Giving the broker an idea of your preferences will better allow them to select the right crew for you.

Gratuity/tipping

  • In terms of gratuity, crew members do expect a tip and are often working towards it
  • The standard in the industry is 10% on top of the charter net fee
  • If your guest / client is a keen tipper, let your broker know. This can be passed onto the crew to further incentive them to provide a first class service

In order to book a luxury mega yacht vacation , you must sign a contract with the owner of the yacht. Several standard contracts are regularly used within the crewed yacht charter industry. Luxury Yacht Charter Contracts

Many mega yacht charters are booked using a MYBA contract, which was designed by the Mediterranean Yacht Brokers Association. Other crewed yacht charters are booked with contracts created by the AYCA, which is the American Yacht Charter Association. Regency is a member of MYBA and Kathleen Mullen is a Past President and current Treasurer of AYCA and a member of the Charter Yacht Brokers Association (CYBA). CYBA created a new contract in 2020. Others use what is called a bareboat demise contract.

These various luxury yacht charter contracts cover everything from the yacht’s weekly rate to water toys usage to the conduct that is expected of charter clients. Drug use, for instance, is strictly prohibited in ALL charter contracts and can result in the immediate end of a charter with no refund due to the client. Safety too, is covered in these contracts, which state that the captain will work to meet all your desires—but retains the right to make final decisions to ensure the safety of the yacht, crew and guests. You can expect to see clauses that outline the maximum number of people allowed onboard, what happens if there is a breakdown of the yacht’s equipment, and what insurance the owner must have in place.

The yacht’s representative decides which contract will be offered based on things like the yacht’s certification in the country where it is registered, including whether it is officially listed as a private or commercial vessel. When you charter a yacht from a reputable charter broker  a written agreement will be drawn up for you to sign, a contract between you and the boat. It is nothing to be nervous of. It simply details what you’ve paid for, and it works to protect you the customer. Some people don’t look at it, some go through with a fine tooth comb. Something in-between these two extremes is probably appropriate and without exhaustively going in to every line we’d like to draw your attention to key points that you may want to check out.

The agreement will name the yacht owner and where they are domiciled. This is important information that can also tell you about the vessels ‘flag’, the State it operates under. If it is unclear it may be prudent to ask your broker what flag the vessel flies as not all countries regulate their commercial vessels to the same standard. Your broker will gladly resolve any concerns.

The number of guests, the number of days, and the cruising area, are usually un-changeable without financial penalty so check these details are correct.

What is included in the agreed price, and importantly what is not included, is usually set out at the start of the contract. Check that this is the same as you were told by the broker. Included items are usually most expenses related to the running of the vessel. Things like fine wines, off-yacht excursions, and airport transfers are usually excluded. Make sure you know what ‘extras’ you are liable for. A lot of power boats, for example, exclude fuel costs. Any additional conditions, for example if smoking is permitted, or what happens to the price if the number of guests increase, will be shown as well.

After details on payment and cancellation there may be an important note on delivery of the vessel and what would happen if, very unusually, the yacht is not delivered for the start of your charter. It may stipulate the condition of linens and furnishings you should expect. Take a close look at this and any accompanying note on the definition of Force Majeure.

There is usually a reminder that for the period of the charter it is your yacht to do with as you please and to go where you like within the agreed charter area. That said, the Captain is in command not you and all decisions relating to the safe operation of the vessel are up to him or her. This means that the choice of sails, or which anchorage, are ultimately determined by the Captain.

There will be a line or two about the responsibility of the owner to ensure adequate insurance, and what the owner is not liable for. In practice this amounts to loss or damage to your personal property, or if you undertake hazardous or dangerous pursuits.

Most yachts make a note in the contract about the use of drugs or any illegal activities and how this would result in immediate termination of the charter without any refund.

It is worth taking a brief look at the procedure in case there are any disputes and the venue for mediation or action.

Finally, there is often a reminder for you to take out your own Trip Cancellation Insurance. Talk to your broker about this.

After you have chosen your desired yacht, your yacht broker will prepare a legally binding contract; usually a standard agreement with conditions set by the terms applicable to the destination. Before you sign on the dotted line, it is important that you understand what it is that you are paying for and when it is due.

Base charter fee: All-Inclusive vs Plus Expenses

When it comes to crewed luxury yacht charters, you can choose from two types of vacations- "All-Inclusive" or  "Plus Expenses" charter experiences. But what do these classifications entail? Let's briefly compare:

  • All-Inclusive Yacht Charters Certain charters, particularly small catamaran and monohull sailboat charters in the Virgin Islands, wooden Gulets in Turkey or Phinisis in Indonesia, offer different all-inclusive pricing packages. This means that the rates depend on the number of guests and cover some or all meals and beverages, water sports, and fuel expenses. However, dockage fees and taxes are typically billed as additional costs.
  • Plus Expenses Charters The rates for larger sailing or motor yachts are exclusive of operational costs, which are to be paid additionally. With these high-end charters, the base rate covers only the yacht rental. Extra charges, such as for food, beverages, fuel, dockage, port taxes, and other expenses, are billed separately. These running costs are usually covered by an Advance Provisioning Allowance (APA) payment, generally set at 20-35% of the base charter rate depending on the size and location of the yacht. This amount is paid before the start of the charter.

Charter rates are typically quoted per week (7 days), which in superyacht terms is generally accepted as the minimum period for yacht charters – although this is by no means set in stone.

The APA in Plus Expenses charters is typically about 25-40% of the yacht's base weekly charter rate (based on the size of yacht, location and yacht's fuel efficiency). This fee is collected before the start of the charter and acts like an expense fund that the captain can utilize during the trip to cover costs such as fuel, food and beverages, dockage fees and ad hoc incidental expenses.  At the end of the charter the captain will prepare a detailed statement of the APA expenditures, along with any unspent APA funds returned in cash.

Should expenses exceed the initial APA, you might need to top up the fund during the charter. This replenishment can be done in cash, but many opt to establish accounts with their charter brokers. These accounts can then be accessed upon the captain's request for additional funds.

Taxes & Value Added Tax (VAT)

For most yachts, regardless of being All-Inclusive or Plus Expenses , local taxes or Value Added Tax are NOT incorporated into their charter rate. It falls upon the charterer to pay these tax expenses before the charter commences. Tax rates can vary greatly depending on the destination; here's an brief overview of tax rates in some of the most sought-after yachting locations:

In the European Union (EU) recent harmonising changes to tax laws have affected VAT rates across most of the Mediterranean region. EU tax laws state that VAT will apply to vessels embarking or disembarking within their waters, although rates for VAT vary depending on the European destination. In France the current rate is 20% and in Italy it is 22%, whilst Turkey and Montenegro both charge 0% for EU-flagged yachts cruising their waters.

VAT also applies to yacht charters cruising The Bahamas , plus may also apply in some Caribbean islands.

Crew Gratuities

Although tipping is optional, it's customary to leave a gratuity for the crew. The typical range for tips is between 10-20%, and it should reflect the quality of service you and your guests experienced during your yacht charter.

It's best practice to hand over crew gratuities to the captain for distribution, ensuring that every crew member is fairly recognized. This approach is important because there are often less visible crew members, like the engineer and sous chef, working diligently behind the scenes to guarantee the success of your charter. It would be unfair for their contributions to go unrecognized.

Cancellation Insurance

Charterers have the option to buy cancellation and curtailment insurance, akin to travel insurance. This insurance can provide coverage for costs in case the charter needs to be canceled or shortened. Charter brokers are equipped to assist in evaluating different insurance choices and typically offer a variety of options.

Delivery Fees

These fees are not typical for most charters, but if your charter takes place outside the yacht's regular cruising territory or a significant distance from its homeport, you might need to pay delivery fees. Usually, this will just involve covering the fuel costs for the journey.

The charter fee varies from one yacht to another for a number of reasons, such as its size, age, onboard amenities and time of year the yacht is chartered. We've listed below some of the most common factors that affect the base rate of a rental yacht.

Charter seasons

A yacht charter season can refer to the weather patterns of a particular destination or the peak times when demand for charter yachts is at its highest. Yacht charter seasons, therefore, are broken down into two distinct categories: Summer/Winter, and High/Low season.

In terms of the yacht's base charter fee, high season rates will apply to the most popular periods for yacht charters – such as July and August in the Mediterranean or Christmas and New Year in the Caribbean . Low season rates will generally apply to all other periods.

Major events such as the Monaco Grand Prix and Cannes Film Festival are generally categorised as high season events , regardless of where they fall in the season, with yacht prices generally higher around these dates due to popular demand.

Unless you are keen to charter a yacht for a particular high season event, it is worth considering your dates carefully.

Shoulder seasons

The months straddling the high and low seasons are known as shoulder months, for example April and September for yacht charters around the Mediterranean, and can share much of the same weather and beautiful cruising conditions as the peak season whilst charter rates tend to be lower, making these months a great time for chartering a yacht.

Aside from seasons and events, yachts of the same size can often differ in price based on their onboard amenities. A yacht which boasts a cinema or lavish water toys may have a higher base rate compared with a yacht with minimal amenities of the same size.

Once you are clear on the base charter fee of your chosen yacht, it is important to learn about the additional costs that will be applied on top, depending on the type of charter contract used.

MYBA Charter Agreement

The most widely used contract for yacht charters is a MYBA agreement (Worldwide Yachting Association, formerly known as Mediterranean Yacht Brokers Association), which operates under Western Mediterranean Terms (WMT) . 

This contract, often referred to as a "plus all expenses" contract, requires that you pay for items, such as fuel, delivery fees, food and drink, local taxes and dockage fees, as an additional expense applied over the base charter fee.

Typically, a charter party (this is the collective term for the total number of guests on a charter) will accumulate additional costs of between 25% to 30% of the base charter fee, depending on what is consumed. These expenses can be tracked through the use of an Advance Provisioning Allowance (APA) which we will cover in the next section.

Other charter contracts

Caribbean Terms Inclusive (CTI) – sometimes referred to as Standard Caribbean Terms (SCT) – is another contract regularly used by the yachting industry, the terms of which are generally employed by smaller yacht charters in the Caribbean. 

Otherwise known as a "mostly all-inclusive" agreement, CTI differs from Western Mediterranean Terms as it includes three meals, plus up to four hours cruising, per day.

In addition to the commonly used MYBA terms and Caribbean Terms Inclusive, there are also less frequently used terms such as Standard Eastern Mediterranean Terms (SEMT) and Greek Terms (GT). 

SEMT operates much in the same way as CTI, except it includes only two meals per day for guests instead of three, as it is assumed guests will dine ashore in the evenings. Greek Terms are similar to the MYBA terms apart from harbour and berthing fees, which are included under GT terms so long as they are within Greek waters.

Yacht Charter Contracts

Typically, the APA accrues to approximately 25% to 30% of the base charter fee, though this does of course depend on your charter party’s tastes and requirements and could be far less or far greater than this estimation. For instance, charter guests who intend to regularly dine on caviar and vintage wine can expect to pay more, whereas guests on a sailing yacht charter that is anchored at sea for most nights can expect to save on fuel costs and hefty marina fees. 

You can request an APA estimate from your yacht broker based on your charter party's onboard expectations.

What happens next?

The APA is payable one month prior to boarding the charter yacht (see 'Payment Structure' below), and is generally paid direct to the Captain.

Once the APA has been paid it will then be retained as a bank account of sorts, from which the Chef can provision the yacht ready for your charter and the Captain can make expenditures while keeping a strict record of what has been spent. It is important to note that all additional costs incurred throughout the charter are charged at cost with no mark-up.

At any point during the vacation you can request an up-to-date summary of the accounts as a way of keeping track of expenditures.

When you think of fuel costs, you may think of what is consumed by the yacht over the course of your charter.

However, there are further fuel costs to take into account that you may not have considered. These include;

  • Personal watercraft toys, such as jet skis
  • Tender boats used for transporting guests to and from the yacht, or for water sports activities
  • A yacht's generators whilst at anchor (shore-side electricty is used when docked at a marina)

Furthermore, the distance travelled and the speed at which the yacht cruises also affects the overall fuel costs, so it is important to bear these factors in mind when settling on your itinerary. 

Dockage fees

These may vary widely depending on the destination and time of year from minimal to extravagant (think Port Hercule in Monaco during the Grand Prix).

If you are interested in booking any nights in marinas during your yacht charter, you should liaise with your broker who can advise on the various options available, including prices, around your chosen location and dates.

In general, the base charter fee of a yacht will include insurance for marine risk and third party liability insurance, which covers accidental damage and personal injury. It will also cover use of the yacht's watertoys and equipment.

Additional insurance

Although insurance is not generally connected to charter costs, it is useful to consider should you wish to take out additional insurance such as Cancellation and Curtailment cover which is calculated at 2.5% of the charter fee for the unforeseen cancellation of a charter, and can prove a worthwhile investment as well as providing peace of mind.

You should check with your broker about the level of insurance built into your charter contract before signing. 

Other taxes 

Local taxes may also apply in certain countries, therefore it is important to speak with your yacht charter broker to clarify what additional taxes are applicable to your chosen destination and itinerary.

Whilst the payment structure can vary depending on the contract, in general charter payments are made as follows;

  • 50% of the charter fee is payable upon signing the charter agreement, which confirms the booking.
  • The remaining 50% of the charter fee, APA (usually between 25-30% of the base charter fee), delivery and/or re-delivery fees, applicable taxes, plus any additional agreed amounts are payable one month prior to commencement of the yacht charter.
  • Any balance of monies due are to be paid on the first working day prior to completion of the yacht charter.

The base charter fee for a yacht can differ for a number of reasons, including;

  • Size and age of the yacht
  • High/low seasons, and major events such as the Monaco Grand Prix

There will also be additional amounts to pay on top of the yacht's base charter fee, which can include;

Yacht Charter Party Agreement

CHARTER AGREEMENT made this day of by and between Yacht Owner/Corporation (hereinafter referred to as the OWNER)

CHARTERER: (hereinafter referred to as the Charterer) for charter of vessel described below.

TERMS AND CONDITIONS:

Included/Excluded: (Unless otherwise noted under Additional Conditions): the charter fee includes the services of a Captain and Crew, meals, standard ship’s bar, fuel, and all expenses related to running of the vessel and use of on-board sports equipment. Charter fee does not include diving, scuba equipment, premium beverages and fine wines, excessive alcoholic consumption, off yacht excursions, dockage, cruising taxes and permits, telephone, airport transfers and crew gratuities, or similar expense incurred by the CHARTERER.

ADDITIONAL CONDITIONS:

1. PAYMENTS:  It is understood that charter fees will be deposited in an Escrow Account and will be disbursed to the OWNER in the following manner: Not more than 35% of the charter fee plus delivery fees and other additional expenses as applicable not more than ten (10) days prior to the start date of the charter period. The balance of the charter fee will be dispersed no earlier than the start date of charter. It is further understood that the OWNER considers charter fees non-refundable. Should the CHARTERER cancel before the charter term begins, deposits will be refunded under the following conditions: Fees will be refunded pro rata, less a service-fee equal to the BROKER’S full commission if the yacht is rebooked for the same period or portion thereof. If rebooking is not possible, no refund will be made. If the OWNER cancels, the OWNER shall reimburse the CHARTERER, through the broker, for all fees paid as of that date, including BROKER’S commission.

2. DEFAULTS IN PAYMENT:  Should any installment of charter fees not be paid on the date designated, the CHARTERER will be advised and will have 14 days to pay balances due. If the default continues thereafter, the OWNER shall be so be advised by the BROKER, and the OWNER shall have the right to cancel this Agreement without prejudice to his rights in respect of any arrears of charter money, or of any breach by the CHARTERER of the conditions contained herein.

3. BROKERAGE:  The owner and CHARTERER recognize American Yacht Company, Inc. or Luxury Yacht Vacations, Ltd. as the sole BROKER in connectionwith this Agreement. The OWNER agrees to pay said BROKER customary and usual brokerage fees in connection with said charter and for any extensions and subsequent charters of the yacht by the CHARTERER arranged by BROKER for a period of 2 years from the end of the initial charter. The parties, understand and agree that the function of the BROKER is solely that of arranging the charter and that the BROKER is not responsible for the CHARTERER’S, OWNER’S or crew’s actions at any time, nor will the BROKER be liable for the satisfaction of the CHARTER or any actions or events outside BROKER’S direct control.

4. DELIVERY:  The OWNER agrees to deliver the yacht at the Port of Boarding in full commission and in proper working order, having all licenses required for any jurisdiction within the area of charter, outfitted as a yacht of her size, type and accommodations, with full equipment, inclusive of that required by law, and fully furnished, including galley and utensils, blankets, linens, and towels; in staunch, clean and good condition throughout and ready for service; and, further agrees to allow demurrage pro rata to the CHARTERER for any delay in delivery, unless caused by Force Majeure. Should it be impossible for the OWNER to make delivery within twenty-four hours after the start of the charter period (for any reason other than Force Majeure), the CHARTERER may cancel this Agreement. Any charter fees paid in advance shall be returned in full to the CHARTERER at the CHARTERER’S option without further liability to the OWNER, shall be refunded pro rata by agreement, and the BROKER shall retain its full commission.

5. FORCE MAJEURE:  Force Majeure is defined as any cause attributed to acts of GOD, accidents, natural disaster, weather or other occurrences beyond the reasonable control of the OWNER, and not caused by the OWNERS negligence. No warranty is made as to the suitability of weather with respect to this charter. If a Named Storm threatens or is forecast to threaten the expected location of the charter yacht, as determined by the Captain in his/her sole discretion, the Captain shall have the option of terminating or canceling the charter any time that he/she deems necessary. No refund is provided for cancellation due to weather.

6. AUTHORITY:  The OWNER warrants that the Captain meets all requirements necessary to legally command the yacht in the area chartered. While it is agreed the CHARTERER may determine the general movements and destination of the yacht within the boundaries of this Agreement, it is understood that the Captain is in full command, and that the CHARTERER agrees to abide by his judgment as to clearance, sailing, weather conditions, anchorages and other pertinent matters.

7. LIENS:  The CHARTERER, his agents, and/or employees, have no right or power to permit or suffer the creation of any Maritime Liens against the yacht. The CHARTERER agrees to indemnify the OWNER for any charges or losses incurred as a result of a breach of this paragraph, including reasonable attorney’s fees.

8. NON-ASSIGNMENT:  The CHARTERER agrees not to assign this Agreement or sub-charter the yacht without the OWNER’S consent in writing.

9. RESTRICTED USE:  The CHARTERER agrees that the yacht shall be employed exclusively as a pleasure vessel for the sole and proper use of himself, his family, guests and servants, during the term of this charter, and shall not transport merchandise, or carry passengers for pay, or engage in any trade, nor in any way violate the Laws of any Government within the jurisdiction of which the yacht may be at any time, and shall comply with the law in all other respects.

10. NAVIGATION LIMITS:  The CHARTERER agrees to restrict the cruising of the yacht to the are specified on the 1st page of this agreement, cruising area.

11. INSURANCE:  The OWNER agrees to keep the yacht fully insured against fire, marine and collision risks and with protection and indemnity coverage for the full term of the charter period. The CHARTERER shall not be liable for any such loss or damage covered by such insurance. Failure by the OWNER to provide such insurance will burden him with the same responsibility as if the yacht were so insured. The CHARTERER may purchase additional Charter liability insurance at his /her expense.

The OWNER shall not be held responsible for loss or damage to personal property or for any injury suffered by the CHARTERER, or any member of his party, during the term of this charter, regardless of whether any such loss or injury occurs on board the yacht or elsewhere, unless such loss, damage or injury is the direct and proximate result of OWNERS sole negligence. More specifically, but without limiting the foregoing, the OWNER and his insurance underwriters accept no responsibility or liability for accidents, injuries or death related to the yacht’s dinghy, swimming and/or the use of snorkels, masks or allied equipment (such as scuba equipment), water skiing, windsurfing, personal watercraft, spinnaker flying, halyard flying, or other sports equipment, whether or not supplied by the OWNER or CHARTERER.

12: ACCIDENTS:  The OWNER agrees that should the yacht, after delivery, sustain breakdown of machinery, or be disabled, or damaged by fire, grounding, collision or other cause so as to prevent its use by the CHARTERER for a period of twenty-four (24) consecutive hours or more, or should the yacht be lost or said damage(s) be so extensive that the yacht cannot be, or is not repaired within twenty-four (24) hours, none of the above being brought about by any act or default of the CHARTERER, the CHARTERER shall have the right to terminate the charter. The OWNER shall make a pro rata return of all charter fees to the CHARTERER from the time of such loss or damage.

13. DRUGS AND OTHER ILLEGAL ACTIVITIES:  The use, transportation, or possession of illegal drugs or narcotics (INCLUDING MARIJUANA) or of any other contraband, or the participation in any other unlawful activity is strictly prohibited. The participation in any of these activities by CHARTERER, or by any guest of the party constitutes a breach of the charter and shall be cause for immediate termination of this Agreement without refund of any payments made by CHARTERER. CHARTERER will be held responsible for any loss or damage to the yacht due to any such violations and will be put ashore at the next port of call.

14. REDELIVERY:  The CHARTERER agrees to redeliver the yacht, her equipment and furnishings, free and clear of any indebtedness incurred for/by the CHARTERER, at the expiration of the charter. The CHARTERER also agrees to be responsible for and to replace or make good any injury to the yacht, her equipment and furnishings caused by himself or by any of his party, less ordinary wear and tear, except to the extent such claims are covered by insurance as provided above. This means that the CHARTERER shall be responsible for any costs up to the amount of any deductible. Should the CHARTERER hinder the yacht’s redelivery to the place and time stipulated, for whatever cause, he shall pay the OWNER demurrage pro rata for additional charter time, plus any other losses the OWNER sustains related to the delayed redelivery. If the delay in redelivery is due to Force Majeure, the CHARTERER is not held responsible for any additional charter fees.

15. DISPUTE RESOLUTIONS:  Should the OWNER and CHARTERER be unable to reconcile any differences that may arise with respect to the charter or this Agreement, such dispute shall be submitted first to mediation before a mediator mutually agreed upon by the CHARTERER and the OWNER, with the cost thereof divided equally between the parties. The mediation will be in accordance with such rules as the parties may designate agree upon and in the event the dispute cannot be resolved by mediation, then either party may resort to an action as provided in paragraph 16.

16. VENUE:  The venue of any action arising from this Agreement shall lie exclusively in the Courts of the City and State of Owner’s residence, unless another place is mutually agreed upon, and both parties shall submit to the jurisdiction of such court.

17. EXECUTION OF AGREEMENT:  The OWNER and CHARTERER, whose signatures need not be affixed to the same copy of the YACHT CHARTER PARTY AGREEMENT, may transmit the Agreement by facsimile or other electronic means. The separately signed Agreement, and/or copies thereof, shall constitute a binding Agreement between the OWNER and the CHARTERER.

18. TRIP CANCELLATION INSURANCE:  The CHARTERER acknowledges that trip cancellation insurance has been offered and that he/she has the choice of either accepting or declining such coverage.

This Agreement must be signed and returned within three (3) weeks of receipt by the OWNER or the owner’s representative via electronic means to the delivery address provided. Otherwise the CHARTERER has the right to cancel without penalty.

I have read and understood the terms of this Agreement, plus all additional conditions and/or addenda listed above, before signing. Therefore, to the true and faithful performance of the foregoing YACHT CHARTER PARTY AGREEMENT, said parties hereto bind themselves, their heirs, executors, administrators and assigns, each to the other. IN WITNESS WHEREOF, the parties have hereunto set their hands on the date written below and have initialed each page of the Agreement.

Kamaz FTL hauler registers NatCar brand

MOSCOW. Sept 4 (Interfax) - National Carrier JSC, the full truckload freight trucking company headed by former Globaltruck CEO Ilya Sattarov that Russian truck maker Kamaz founded this summer, applied to register the brand NatCar at the end of August, the registry of federal intellectual property service Rospatent showed.

The NatCar brand is also mentioned in the recruitment ads of National Carrier, which is actively looking for E-class drivers. It is offering working with this year's model Kamaz diesel trucks from the flagship K5 line and new dry goods (curtainsider) and refrigerated trailers.

National Carrier was founded on July 7 in Moscow with charter capital of 1 billion rubles, the Unified State Register of Legal Entities showed. The company registered two branches in early August, in Yekaterinburg and Elektrostal, Moscow Region. The company specializes in truck logistics and associated activities, including digitization processes.

A spokesman for National Carrier told Interfax earlier that the company plans to provide FTL trucking services using its own fleet, "as well as the resources of hired truckers." The company's fleet will initially consist of 400 semi-trailer trucks with a 50/50 ratio of curtainside to refrigerated trailers, and it plans to primarily operate on domestic routes, he said.

The company has preliminary agreements with major customers among marketplaces and retailers in the FMCG and DIY segments, the spokesman said. Strong demand for trucking services is expected toward the end of the year, so there is interest from customers, he said.

Kamaz marketing director Ashot Arutyunyan announced at the International Moscow Automotive Forum at the end of August that the truck maker was the principal investor in National Carrier. He did not comment on the new company's shareholder structure, but said it is a Kamaz startup.
