Yacht management company fined for breaking rules

An island-based yacht management company has been fined more than £4,000 for not complying with regulations designed to thwart money-laundering.

The Financial Services Authority penalised Dohle Yacht Management Services Limited under section 27 of the Designated Businesses (Registration and Oversight) Act 2015.

Dohle was found to have breached anti-money laundering rules as well as the Countering the Financing of Terrorism code.

The civil penalty imposed on Dohle, which is based at Fort Anne on the South Quay in Douglas, is the sum of £5,896 which is discounted by 30% to £4,127.

The FSA said the level of the penalty reflected the fact that Dohle had co-operated with the authority and agreed settlement at an early stage.

Dohle has been registered with the FSA as an external accountant since October 2017.

Its 2020 annual return to the FSA indicated high proportion of foreign politically exposed persons.

An inspection in April 2022 identified a significant number of contraventions of the Code by Dohle across its foreign politically exposed persons client base.

The authority told Dohle to suspend all existing and established business relationships and refrain from establishing any new business relationships until the authority could be satisfied that it could demonstrate its compliance with the code.

Following the inspection, Dohle had decided to cease providing the services of an external accountant and has subsequently requested that the authority de-register under the Act.

The FSA said that Dohle had engaged positively ty throughout this matter in a timely and constructive manner.

Contraventions of the code identified by the inspection included:

The firm’s business risk assessment was not up-to-date and did not include an overall assessment of the risk of money laundering and terrorist financing of its business or its customers.;

The customer risk assessments of Dohle did not contain the prescribed level of detail nor were they updated on a regular basis

Code-compliant customer due diligence and enhanced due diligence was not on file in all cases.

The foreign politically exposed persons customer files did not adequately demonstrate or identify customers source of funds and source of wealth.

The ongoing monitoring processes of Dohle were not effective

Monitoring and testing of Dohle’s compliance with the code was not undertaken

Dohle failed to establish procedures and controls which were suitable or appropriate to take into account the risks posed to DYMSL, nor the specific processes relevant to the same

Joe Lewis’ $250 million superyacht, ranked among the world’s 25-most valuable, sets sail after he pays US fine

Joe Lewis’ superyacht is on the move again after spending most of the past year holed up in a Mediterranean port while the British billionaire faced insider-trading charges in the US.

His 322-foot (98-meter) Aviva — which he put up as collateral for bail —  has traveled more than 400 nautical miles from Malta to cities along Albania’s coast as well as the Greek island of Zakynthos since  he was sentenced  April 4 to three years probation, according to data compiled by Bloomberg.

After departing Zakynthos earlier this week, the Tavistock Group founder’s yacht was near Kalamata in southern Greece on Thursday morning local time, the data show. It’s the most the roughly $250 million vessel has traveled in about seven months, though it’s unclear if Lewis is on board.

Lewis, 87, pledged his yacht along with his private jet to secure his release following his arrest in July. A few months later, Aviva docked until April 5 in the Maltese capital of Valletta, where it can cost as much as €750 ($800) a night to moor vessels that exceed 75 meters.

Lewis, who was scheduled to have eye surgery in London recently, was prohibited from setting foot on the yacht that has long served as part-residence, part-office while awaiting trial. He was only allowed on board after paying a $5 million fine after sentencing, which he settled soon after the verdict in Manhattan.

A representative for Lewis, who has a net worth of about $7.3 billion according to the Bloomberg Billionaires Index, declined to comment.

Lewis, whose global empire includes five-star hotels, private lenders and enclaves for the wealthy, launched Aviva in 2017. It includes eight guest suites, a helipad, padel tennis court, spa and a cinema. It ranked among the world’s 25-most valuable superyachts shortly after its launch, alongside those owned by Middle Eastern royals.

The yacht has also displayed works from Lewis’ private art collection, which is valued at more than $1 billion and includes pieces by Picasso, Freud, Klimt and Degas.

Events that authorities say took place on the yacht were a key piece of evidence that prosecutors used against him. 

At dinner one night in September 2019, the billionaire received favorable news about Mirati Therapeutics Inc., an oncology company where he was a major investor, leading him to pass along the tip to a host of people, including the pilots of his private jet, according to US regulators.

Those pilots — Bryan “Marty” Waugh and Patrick O’Connor — were also charged with trading on inside information. O’Connor pleaded guilty to securities fraud and conspiracy and is due to be sentenced in May, while Waugh is fighting the charges.

Coachella weekend 2 wrapped up on a low note, financially speaking, as the music festival is facing a $28,000 fine over Lana Del Rey 's set.

A rep for the City of Indio, where Coachella takes place, tells TMZ ... the singer's show went over 13 minutes on Friday night. Might not sound like THAT bad of an infraction, but it's enough to trigger the hefty fine.

Lana's weekend 2 set featured 19 songs in total ... including a surprise performance from Camila Cabello , who performed her new single, "I LUV IT."

However, we're told this is the only fine from the music festival's 2 weekends ... so, overall, the Coachella organizers probably see this as a win.

The $28K is a huge difference from last year's curfew violations, which resulted in $117,000 in fines . Similarly, in 2022, the festival's 2 weekends -- plus 1 weekend of Stagecoach -- resulted in the city handing out $61K in fines.

Still, from what we've been told, this year's event was noticeably less rowdy than previous years.

As TMZ previously reported ... weekend 1 was down 20% in arrests and down 43% in citations.

Yet, this might have something to do with the lackluster ticket sales for this year's event. There were loads of Coachella passes still up for grabs on the website ... strikingly different from past years, where the event sold out in less than a day.

So, while the decrease in arrests and fines is good for the city ... it might be a bad sign for Coachella's future.

ADVICE ON REGULATORY AFFAIRS, REGISTRATION AND OPERATIONS

The regulatory framework, including the flag, registration type and classification society, must all be matched to meet the owner’s needs, use, and company structure. These all vary depending on the owner’s wish to have the vessel available for charter or to register it commercially for financial implications.

OPERATIONAL SAFETY AND FEASIBILITY

From the thousands of risk assessments received by our compliance team running International Safety Management (ISM) systems on board our fleet, we can identify where vessels can be designed better.  This can range from the protection of crew, to the flow of guest services, to freeing up crew to better service the owner and guests whilst on board, thus ensuring that solutions work for the vessel as an operational platform and not just an aesthetic one.

ENGAGEMENT WITH CLASS AND FLAG ON SPECIALIST DESIGN FEATURES

Through the varying yacht code equivalence procedures such as the REG Yacht Code or the SOLAS ‘Alternative Design and Arrangements’, we have a track record of gaining approval for designs that are outside of the prescriptive regulations.  This allows for the best design or engineering solution to be taken advantage of to provide a truly unique vessel to the owner.

New Construction Project Management and Support

We work with clients to help develop their concept during the pre-project phase to provide best practice and smart solutions to meet the owner’s ultimate vision.

We work in cooperation with the designers, shipyards, class and flag to turn the owner’s vision into reality, whilst ensuring the finished yacht complies with the prescriptive requirements of the various regulations and statutory codes.

We have experience in the development of technical specifications and have considerable practical knowledge to assist in the development and agreement of this vital aspect of the tendering and building process, ensuring the yacht is capable of operating as the owner requires.

Once construction begins, we can dovetail our pre-project work into the build. Whether this is overseeing the plan approval and inspection work or simply fitting in with your team to offer best practice, guidance and support.

We can also take on specific aspects of the build or projects, as well as the management and control of change orders.

On delivery, we work to ensure that all as-built drawings, test protocols and documentation are identified and provided to ensure a smooth handover to the operating team.

If required, we can also provide full after-delivery warranty management to ensure a successful outcome to warranty claims with minimal disruption to the new yacht’s operation.

Maintenance Periods and Refit Management

A refit or major maintenance period can be an expensive and time-consuming venture.

Döhle Yacht’s technical team can support the owner and crew with the initial planning, through the project and with after-project warranty management.

Our extensive experience in refit and major maintenance periods has taught us that, unless carefully planned and managed, the time and funds invested in a refit/major maintenance period frequently do not produce the results, or value for money, the owner hoped for.

To ensure a positive result, Döhle Yacht’s team take a structured approach to planning and managing a refit/major maintenance project using their market knowledge and first-hand experience to guide the owner’s team in both the scope of work and who is most suited to undertake it.

We liaise with shipyards, sub-contractors, class societies, flag administrations and specialists throughout the project to identify and manage risks, avoid costs escalating and achieve on time redelivery of the yacht for the owner.

After redelivery we can manage warranty claims to achieve a successful outcome for the owner and the repair of the warranty defect, whilst minimising any possible disruption to the yacht’s schedule.

Operational Technical Support

Our team of experienced technical yacht managers provide effective and knowledgeable support to the owner’s team and crew during normal operation, when there is a problem and during major maintenance periods.

Whether it is providing assistance to solve a stand-alone technical problem, assessing an equipment upgrade, ordering a spare part or dealing with an incident, we are available to assist with our technical expertise, knowledge and experience.

Our team have many years’ experience working worldwide with all sizes of yachts and with all types of technical support, including incident support.  We understand what is required to effectively assist an operational yacht and her owners.

Our aim is to use this experience to maximise a yacht’s availability whilst minimising costs and preserving the value of the yacht asset.

Engineering and Statutory Consultancy

Döhle Yachts is able to help with any aspect of the design, build or operation of the vessel, whether practical or regulatory.  Unlike most consultants, we have the advantage of drawing from our experience of the full life cycle of yachts through our various offered services.

We can work on standalone projects and support the existing onboard and shore-based team for a discreet project, operation, refit or task.  Additionally, our team of naval architects, chief engineers and project managers are able to provide services for vessels in operation during design, build or refit.

Our consultancy services are available to anyone, even those not currently contracted with Döhle Yachts for any other services.  This enables everyone to take advantage of the industry experience Döhle Yachts has to offer.

Maintenance Advice, Budgeting and Planning

The ongoing maintenance and upkeep of a yacht requires substantial investment, particularly during the five-yearly statutory service period.

Our experience is that owners often have many questions on where and when it is best to invest funds, such as:

• How long should my paintwork last and should I pay for a repaint now or later?
• Are the upgrades being proposed really needed and how will this investment effect the yacht’s value?
• Should I invest in all of the maintenance period worklist presented or only parts of it?
• How often should my yacht be in a shipyard or under survey and how can I avoid these periods conflicting with my cruising plans?

In order to address these questions and ensure the yacht’s maintenance is funded in a planned and controlled manner, Döhle Yachts can provide an outline five-year maintenance plan and budget. In addition, we can review the proposed maintenance worklist for each maintenance period and provide comments and options to the owner and crew on the proposed works.

This approach provides a clear view of a five-year period of the yacht’s availability, outlines maintenance costs and clarifies the major investments required to ensure the yacht remains operational and in compliance with all regulations.
