Reminiscing “Freedom”: a 12 Metre Classic

Forty years ago this past September, in the waters of Rhode Island Sound just off the coastal city of Newport, a crew of Aussies shocked the sailing world. The 12 Metre Australia II defeated the American boat Liberty to win the 1983 America’s Cup and bring the New York Yacht Club’s 132-year defense of the Auld Mug to a conclusion. It’s safe to say the Cup, and my hometown of Newport, have never been the same.

I spent a lot of time on the sound that summer taking in the action, so when I signed up to volunteer on a marshal boat for the latest edition of the 12 Metre World Championship regatta in August, I found myself on the very same waters, which turned into a pretty nostalgic voyage down a nautical memory lane. But the graceful Twelve I couldn’t take my eyes off wasn’t the winner of the Modern Division, Challenge XII , or even the victor of the Traditional/Vintage Division, Columbia . Nope, I was more or less transfixed on the runner-up to Challenge XII , a striking-blue yacht called Freedom . Of all the entries in the 10-boat fleet, to me, Freedom was easily the most historic and memorable.

Three years before the Australians absconded with the Cup, in 1980, with the estimable Dennis Conner in command, Freedom won the contest in dominant fashion, and it seemed like the New York Yacht Club’s winning streak would go on forever. It was designed by the legendary naval architecture firm Sparkman & Stephens, which had drawn the lines of every Cup winner but one since 1936. Conner was back on the helm in the losing effort in ’83, but he would find redemption, winning the Cup back for the United States in Western Australia in 1987. But for S&S, Freedom marked the end of an illustrious era. The firm would never again create a Cup winner.

For the 12 Metre Worlds, ironically enough, the navigator aboard Freedom was a lanky old Aussie mate of mine called Grant Simmer, who’d served in the same capacity aboard Australia II for his country’s winning effort way back when. With the exception of the gray hair, he looked exactly the same.

This time, however, Simmer couldn’t work his magic. Unlike the America’s Cup, where boats compete in one-on-one match racing, the World Championship event is fleet racing, with everyone out on the track at the same time. It’s a different game. And Challenge XII had a ringer of its own: the president of North Sails, Ken Read, also a longtime America’s Cup veteran. As far as I was concerned, Freedom was easily the prettiest of all the Modern yachts. When push came to shove, though, it was no longer the fastest.

Today’s America’s Cup competition, conducted on closed-course race tracks in skittish foiling catamarans—about as far removed as possible from a stately 12 Metre racing in the open ocean—bears little resemblance to what the event looked like in the early 1980s. And Newport has undergone a radical makeover as well. The shipyards where the Cup boats used to reside between races have been replaced by condos and hotels, and the only real remaining trace of the America’s Cup is the boulevard of the same name. It’s a reminder that the only true constant in life is change.

But for a few afternoons last August, I could shut my eyes for a moment of reminiscence and open them up to see what I can only describe as a fleeting image of a bygone time. Freedom may be a footnote in the history of yacht racing, but the big, beautiful blue boat still looks powerful and fantastic all the same.

Challenge 12 Wins in Trials

The Australian 12-Meter yacht Challenge 12 today defeated Australia II, ending her winning streak of 10 races in the opening round of trials to select the America's Cup challenger.

Australia II, which came back to win her second race today, has an 11-1 record, and Challenge 12 a 10-2 mark to lead the first round of trials, which ended today. The seven challengers from five foreign countries have a break until the second round-robin series, which runs from July 2 through 14.

The next United States trials to select the defender begin July 16. The results of two protests, announced today, altered the standing of the first trials, which ended Saturday. Of two protests it filed against Liberty, Courageous won one. Courageous and Liberty now both have a 6-5 records. Defender has a 5-7 record. A Healthy Margin

John Savage, the skipper of Challenge 12, which represents the Royal Yacht Club of Victoria in Melbourne, said he believed the crew has been sailing better since it arrived here several weeks ago. The crew started sailing together about six months ago but its program was not well organized until several months ago when their financially-strapped effort was rescued by Richard Pratt, an Australian paper box manufacturer.

Today's race was sailed in a 7-knot southwesterly breeze on Rhode Island Sound. On the first crossing of the initial upwind leg, Australia II led by one boat length. By the second crossing, Challenge 12 had taken the lead and moved onto the favored right side of the course to hold a commanding 57-second lead at the first mark rounding. Positioning itself to block Challenge 12's wind on the downwind jibes, Australia II gained some ground only to lose it on the final leg upwind. Challenge 12 won by a healthy 51-second margin.

''It was a very competitive race,'' said Johan Valentijn, the designer of Liberty, a potential cup defender driven by Dennis Conner. ''I don't think either yacht got on the big side of lifts. So maybe Australia II is not as strong as we all believed.''

Conner, Valentijn and other members of their group watched the race from a couple of tenders. Before the race, they approached Australia II, which has a secret keel that is kept wrapped in ''security skirts'' when the boat is out of the water. But Australia II's two tenders quickly moved alongside their charge to prevent the Americans from getting a glimpse of the keel through the clear water. No Holding Back

When asked whether he thought Australia II, driven by John Bertrand, might be holding back a bit because of the Americans' presence, Savage replied, ''If anyone is holding back at this stage, they're fools. We're out there to learn. When the two fastest boats are sailing against each other, they try the hardest.''

In the other two pairings in today's first race, France 3 beat Australia's Advance by 40 seconds, and Italy's Azzurra blew by Canada 1 to win by 1 minute 42 seconds.

In the second race, Australia II was back in form to beat France 3 by 3:23 . Azzurra beat Advance by 3:31 and Britain's Victory 83 topped Canada 1 by 1:15.

The first series of trials to select a challenger ended with Australia II in the lead with 11 points, Challenge 12 with 10, Britain's Victory 83 with 8, Italy's Azzurra with 5, Canada 1 and France 3 4 each and Advance 0.

Challenge 12 to set sail in encore season

With its gleaming black hull and carbon-fiber sails that match, Jack LeFort’s Challenge 12 was a striking addition to Narragansett Bay’s growing 12 Metre fleet last season.

Although the boat will look identical for its 2018 campaign, the Walcott Avenue skipper said key changes will be masked by the shiny livery. Challenge 12, which served as the trial horse for Australia II during the 1983 America’s Cup, will debut this weekend at the New York Yacht Club’s 164th flagship regatta.

According to LeFort, who sailed for the University of Pennsylvania in the 1970s, the boat was in “fairly good shape” when he purchased it near the turn of 2017. With new sails and a freshly painted hull, Le- Fort’s had humble aspirations for his boat’s inaugural season in Rhode Island.

“The goals were to sail it and get to know it,” he said.

Challenge 12 exceeded expectations, however, winning the continental championship in September. Following more winter improvements, the boat now enters its second season under LeFort with a more optimistic outlook.

“We went through some pretty major changes,” he said. “We have some new appendages. We moved the mast position. We’re hoping this year is sort of a breakout.”

This weekend’s three-day regatta is North America’s oldest annual sailing event. It was first run in 1845 on the Hudson River and has been sailed in Narragansett Bay since 1988. This edition will include a sprint Friday around Conanicut Island, followed by buoy racing Saturday and Sunday.

Like many of the 12 Metre boats sailing in Narragansett Bay, LeFort’s crew has its sights set on the world championship in 2019. To account for the evolution of the class since it was introduced in 1907, the yachts are grouped by vintage. The modern Twelves, which includes boats that participated in the America’s Cup during the 1970s and ’80s, will have a fleet of four boats sailing in the annual regatta. Each has been updated with modern hardware and sails, and modified within the bounds of the class rule.

“It’s a development rule,” Le- Fort said. “As tightly as they’re measured, you can do some fun stuff. It doesn’t take too much to separate them.”

Although courses will fluctuate depending on the class during the final two days, the circumnavigation of Conanicut Island is 19 miles long for the entire fleet. The course delivers a full menu of tactical challenges, from the enigmatic tidal flows in the West and East passages to the tricky ocean swells off Beavertail. There also are numerous geographically influenced wind shifts, which are unique to each wind direction. This requires constant focus from the trimming and tactical teams — and a good dose of local knowledge.

Aside from Challenge 12, other entries homeported in Jamestown are Patricia Young’s Tripp 41 Entropy; Expresso, a C&C 35 Mark II owned by Jan Trousilek; and Impetuous, the Swan 42 driven by Paul Zabetakis. Part-time resident Steve Benjamin, a 1984 Olympic medalist who was twice named US Sailing’s yachtsman of the year, will helm Spookie during the regatta.

Spectators also will be treated to an appearance from George David’s Rambler, the 88-foot maxi that has shattered speed records since being launched in December 2014.

NEWPORT, RHODE ISLAND, USA (August 6, 2023) – After participating in a morning parade around Newport Harbor that was punctuated by cannon salutes from yacht clubs and other prime waterfront viewing spots, ten historic 12 Metres moved on to Rhode Island Sound for Saturday’s final race of the  12 Metre World Championship .

To be named the World Champions at the end of the day, Jack LeFort’s (Winter Park, Fla./Jamestown, R.I.)  Challenge XII  (KA-10)  had merely to finish better than fifth among Modern Division’s five entries if Takashi Okura’s Japanese entry  Freedom  (US-30) , close behind in the standings, were to win. The day prior, Kevin Hegarty/Anthony Chiurco’s (Newport, R.I./Princeton, N.J.)  Columbia  (US-16)  already had mathematically sewn up the nine-race series in the five-boat Traditional/Vintage Division.

After waiting for two hours, a windward/leeward course was set (later shortened) for a seven-knot breeze, and  Challenge XII  handily sailed to victory while  Freedom  finished fifth to maintain its Modern Division podium position of second place.  Columbia  finished third, while the fleet’s oldest boat, Mark Watson’s (Newport, R.I.)  Onawa  (US-6 ) ,built in 1928, sailed its way to a clean victory and a claim on second place overall for the Traditional/Vintage Division.

Both the  Challenge XII  and  Columbia  teams, homegrown with mostly local crews, won the Worlds in 2019 when it last was held in Newport.

“Conditions were light, heavy, medium…we went up the (Narragansett) Bay, out on the ocean – it was just a great across-the-board test for the fleet,” said LeFort, whose veteran team includes his wife Lisa as navigator and America’s Cup/Volvo Ocean Race veteran Ken Read as tactician. “The good news is that Sunday’s conditions – light air and lumpy seas – were good for us.”

Racing started Tuesday (August 1) with one race in light 8-9 knot breezes that gave  Challenge XII  (in Modern Division) and Robert Morton’s (Middletown, R.I.)  American Eagle  (US-21)  (in Traditional/Vintage Division) an early boost for winning. Both teams, however, fell to second behind  Freedom  and  Onawa , respectively, after two races on Wednesday, held again in light 5-8 knot air. For Thursday and Friday, 18-20 knot winds proved also to be good for C hallenge XII,  as the team won three of five races held in Modern Division while  Columbia  won all five held in Traditional/Vintage Division.

It’s not about being the fastest boat,” said  Columbia ’s Hegarty, who helmed at the starts and then became tactician while Chiurco drove. “Whomever performs the best, or messes up the least, is going to win. That’s why I love sailing 12 Meters; everything is manual, and it takes muscle and teamwork. There is no other class like it.”

Hegerty said it hit him in the middle of the night on Friday that he and his team – which like  Challenge XII ’s has been sailing together for over a decade – were now two-time 12 Metre World champions. “I woke up and just had a big smile on my face.” The smiles (and cheers) spilled over into Saturday night’s Awards Party, held at the IYRS School of Technology and Trades, which served as headquarters for the six-day event. Kudos especially were given to PRO Mark Foster and his Ida Lewis Yacht Club Race Committee team for their extraordinary acumen and patience.

“Conditions were all over the place and the Race Committee adjusted to them and so did the teams,” said Ida Lewis representative Guy Sanchez.

Other Modern Division teams competing were Peter Askew’s (Key Largo, Fla.)  Enterprise  (US-27 ) , Andrew Rose’s (Newport Beach, Calif.)  Defender  (US-33) , and Dawn Riley’s Oakcliff trainees (Oyster Bay, N.Y.) sailing  Courageous  (US-26) .

Other Traditional/Vintage Division teams competing were Jack Klinck’s (Concord, Mass.)  Nefertiti  (US-19)  and Steve Eddleston’s (Bristol, R.I.)  Weatherly   (US-17) .

The Ted Turner Trophy for most significant contribution to the 12 Metre Class went to Steve Eddleston, Commodore of the 12 Metre Yacht Club Newport Station, who subsequently presented the Tiedemann Trophy for best Vintage yacht to  Onawa .

The Worlds fleet included four boats that successfully defended the America’s Cup when it was sailed in Newport in 12 Metres from 1958 to 1983:  Columbia  – 1958,  Weatherly  -1962,  Courageous  – 1974/1977 and  Freedom  – 1980.

The 2023 12 Metre World Championship was sanctioned by the  International Twelve Metre Association  (ITMA) and hosted by the  12 Metre Yacht Club  Newport Station in partnership with Organizing Authority  Ida Lewis Yacht Club .

Texas Challenge Cup

The Texas Challenge Cup dates to 1986 when it was first held at TCYC.  That year, nine clubs competed on Solings.  The event was held by HYC and LYC over the following three years but was then not repeated until 2001 when it was resurrected.  By 2005, the event included clubs throughout Texas as well as FWBC, GBCA, HYC, LYC, and TCYC.  Sometime after, the tradition was paused again until 2021 when the invitational regatta was hosted at Lakewood Yacht Club.

The 2024 Texas Challenge Cup will be October 5-6 at Lakewood Yacht Club on RS21s.

In F rom Buffalo Bayou to Galveston Bay: The History of the Houston Yacht Club 2nd Edition (2008)

"The Texas Challenge Cup was started by TCYC in 1986. HYC won it that year with nine clubs competing in Solings. It went on for three years, hosted by HYC and LYC and then was not competed for again until it was resurrected in September of 2001 by LYC and HYC. HYC won the 2001 event which saw only the two clubs competing. It was limited to Club members and sailed in three PHRF Spinnaker classes, two PHRF Non-Spinnaker Classes and three Youth Classes. Since then, the event has been sailed every year. Since 2003 TCYC and GBCA have joined in the competition with TCYC taking home the trophy that year. In 2005 and 2006 Fort Worth Boat Club competed bringing back memories of the grand old rivalry FWBC enjoyed with HYC before and after World War II. GBCA captured the trophy in 2006 with HYC winning all the other years. The format has evolved through the years in an effort to keep the competition both fair and spirited."

Tom Brady knocks drone out of sky with throw in challenge from YouTuber MrBeast

Tom Brady is retired , has said he's retired , is most definitely retired .

Still, this won't stop the rumors from coming back.

The former Tampa Bay Buccaneers and New England Patriots legend recently appeared in a video with the popular YouTuber MrBeast , whose real name is James Donaldson, and was faced with a challenge to knock down a drone hovering in the air with a thrown football. Purportedly shot on a $300 million yacht, Brady, who brought two of his children, joined Donaldson and members of his crew.

"All right," Brady says during the video, "if I hit the drone on the first try, maybe I should come out of retirement."

Brady got some warmup throws in. His daughter wasn't confident.

"Dad, you're gonna like miss," she says, to which he responds, "I probably will miss."

Teen died from eating spicy chip in social media challenge, autopsy report concludes

An autopsy of a Massachusetts teen who died after participating in a spicy tortilla chip challenge says his death was caused by eating a large quantity of chile pepper extract

BOSTON -- A Massachusetts teen who participated in a spicy tortilla chip challenge on social media died from eating a large quantity of chile pepper extract and also had a congenital heart defect, according to autopsy results obtained by The Associated Press.

Harris Wolobah, a 10th grader from the city of Worcester, died on Sept. 1, 2023, after eating the Paqui chip as part of the manufacturer's “One Chip Challenge.”

“We were and remain deeply saddened by the death of Harris Wolobah and extend our condolences to his family and friends," Paqui, a Texas-based subsidiary of the Hershey Co., said in a statement Thursday. A phone number listed for Harris’ family was disconnected. The Associated Press left messages seeking comment with friends of the family.

Harris died of cardiopulmonary arrest “in the setting of recent ingestion of food substance with high capsaicin concentration,” according to the autopsy from the Chief Office of the Medical Examiner. Capsaicin is the component that gives chile peppers their heat.

The autopsy also said that Harris had cardiomegaly, meaning an enlarged heart, and a congenital defect described as “myocardial bridging of the left anterior descending coronary artery.”

A myocardial bridge occurs when a segment of a major artery of the heart runs within the heart muscle instead of on its surface, according to Dr. James Udelson, chief of cardiology at Tufts Medical Center.

“It is possible that with significant stimulation of the heart, the muscle beyond the bridge suddenly had abnormal blood flow ('ischemia') and could have been a cause of a severe arrhythmia,” Udelson told the AP in an email. “There have been reports of acute toxicity with capsaicin causing ischemia of the heart muscle.”

Large doses of capsaicin can increase how the heart squeezes, putting extra pressure on the artery, noted Dr. Syed Haider, a cardiologist at MedStar Washington Hospital Center.

But while the autopsy results suggest that a heart defect probably made Harris more vulnerable to the negative effects of the chile pepper extract, people without underlying risk factors can also experience serious heart problems from ingesting large amounts of capsaicin, Haider said.

Udelson and Haider both spoke in general terms; neither was involved in Harris' case.

The cause of Harris' death was determined on Feb. 27, and a death certificate was released to the Worcester city clerk’s office on March 5, according to Elaine Driscoll, a spokesperson for the Massachusetts Executive Office of Public Safety and Security. The state only released the cause and manner of death. Officials will not release a full report, which is not considered part of the public record, she said.

The Paqui chip, sold individually for about $10, came wrapped in foil in a coffin-shaped box containing the warning that it was intended for the “vengeful pleasure of intense heat and pain.” The warning noted that the chip was for adult consumption only, and should be kept out of the reach of children.

Despite the warning, children had no problem buying the chips, and there had been reports from around the country of teens who got sick after taking part in the chip-eating challenge. Among them were three California high school students who were taken to a hospital and seven students in Minnesota who were treated by paramedics after taking part in the challenge in 2022.

In its statement Thursday, Paqui cited the chip's “clear and prominent labeling highlighting that the product was not for children or anyone sensitive to spicy foods or with underlying health conditions.”

“We saw increased reports of teens and other individuals not heeding these warnings,” the statement read. "As a result, while the product adhered to food safety standards, out of an abundance of caution, we worked with retailers to voluntarily remove the product from shelves in September 2023, and the One Chip Challenge has been discontinued.”

The challenge called for participants to eat the Paqui chip and then see how long they could go without consuming other food and water. Sales of the chip seemed largely driven by people posting videos on social media of them or their friends taking the challenge. They showed people, including children, unwrapping the packaging, eating the chips and then reacting to the heat. Some videos showed people gagging, coughing and begging for water.

Spicy food challenges have been around for years. From local chile pepper eating contests to restaurant walls of fame for those who finished extra hot dishes, people around the world have been daring each other to eat especially fiery foods, with some experts pointing to the internal rush of competition and risk-taking.

A YouTube series called “Hot Ones" rose to internet fame several years ago with videos of celebrities’ reactions to eating spicy wings. Meanwhile, restaurants nationwide have offered in-person challenges — from Buffalo Wild Wings’ “Blazin’ Challenge” to the “Hell Challenge” of Wing King in Las Vegas. In both challenges, patrons over 18 can attempt to eat a certain amount of wings doused in extra hot sauce in limited time without drinking or eating other food. Chile pepper eating contests are also regularly hosted around the world.

Extremely spicy products created and marketed solely for the challenges — and possible internet fame — represent a more recent phenomenon exacerbated by social media.

Harris’ death spurred warnings from Massachusetts authorities and physicians, who cautioned that eating such spicy foods can have unintended consequences. Since the chip fad emerged, poison control centers have warned that the concentrated amount could cause allergic reactions, trouble breathing, irregular heartbeats and even heart attacks or strokes.

Harris Wolobah died on Sept. 1, 2023 after consuming the “One Chip Challenge” from Paqui, which contains extracts from the Carolina Reaper and Scorpion peppers.

A coroner has concluded that a 14-year-old’s death in Massachusetts last year was caused by eating one spicy chip as part of a social media challenge, confirming the family’s suspicions . Nearly six months after Harris Wolobah’s death, the coroner’s office was able to determine that Wolobah’s cause of death was cardiopulmonary arrest “in the setting of recent ingestion of food substance with high capsaicin concentration.” On Sept. 1, 2023, Wolobah became ill after consuming the “One Chip Challenge” from Paqui, which contains extracts from the Carolina Reaper and Scorpion peppers, and later died. Paqui asked for retailers to stop selling the chip shortly after Wolobah’s death. The coroner’s report also stated that Wolobah had an enlarged heart and congenital heart defect.

Canada II was designed by Bruce Kirby and built by McConnel Marine in 1982, and competed in the 1983 Louis Vuitton Cup as Canada I. In between the ’83 and ’87 competitions she was radically redesigned, being extended both in her bow and stern, given the addition of a winged keel, and rechristened Canada II. She went on to serve as Western Canada’s challenge for the 1987 Louis Vuitton Cup under the flag of the Royal Canadian Yacht Club. She is extremely fast, agile and tough to beat during every 12 Metre Regatta race!

In 2023, eBird received more than 12.7 million complete checklists from your birding efforts. Whether you’re finding common birds or endangered species, eBird thrives on the enthusiasm and engagement of hundreds of thousands of dedicated participants worldwide who make eBirding part of their regular activities.

In 2024, we challenge you to bird more: submit an average of one checklist a day for the entire year. At the end of the year, three winners will be chosen from among those who submitted at least 365 eligible checklists in 2024. Each winner will receive a pair of Zeiss Terra ED 8 x 42 binoculars! We are thrilled that ZEISS will be a sponsor for this year-long competition.

This challenge may be, well, challenging, but with eBird Mobile in your hand, submitting checklists from anywhere is easier than ever. Don’t have a smartphone? That’s OK. Trusty notebooks still work and can be transcribed once you get home.

Birding and eBirding don’t have to be day-long endeavors. Many eBirders submit short checklists in their garden, over lunchtime walks, or at a quick stop to scan their favorite patch. eBird welcomes short counts from anywhere, so even a parking lot count or quick survey from your doorstep will help you qualify (and contribute valuable data).

Below are a few ideas for how to meet the challenge and have fun doing it.

Count birds at home

Bird observations from home can be some of the most valuable eBird checklists you create, because the only person to count those birds may be YOU!  Consider doing one checklist each morning (or afternoon) in your yard, garden, balcony, or front step. Or make a daily checklist part of your morning routine—these could be “sipping my coffee” counts or “walking the dog” counts. These counts will become more rewarding as your home birding list grows over the year. How many species can you find at home in 2024?

A fun way to explore your home birding is with bar charts : just find and select your home location from My Locations , then tap “Bar Charts (personal)”. If you have multiple locations at your residence, add them to an ‘official’ eBird Yard to create a single bar chart for all your home birding data.

If you submit a checklist a day, after 365 days the bar chart will show the comings and goings of birds throughout the year. The more checklists you submit, the more informative the bar charts become.

Change the bar chart date range to include even more past sightings. What a wonderful way to walk down memory lane!

Take Birding Breaks

Whether you take a lunch break, tea break, or a “stretch your legs” break— turn it into a dedicated Birding Break! Birding Breaks could be a quick survey of nearby park or checking for waterfowl on a local lake. Even a short, 5-10 minute count of birds outside your office can benefit you and the birds we all care about. Find your breaktime patch and commit to it during your workdays to help meet the challenge and build great datasets.

Impromptu counts

Are you usually “out and about” during the day? Shake things up and pick a different eBird spot every day! Maybe there are a few places—parks, ponds, open areas, or forests—that you can cycle through in your weekly routine. Stop wherever you please for your quick daily count: eBird welcomes the variety and it may help keep it fun for you. Check out this note from an eBirder  about their commitment (since 1 Jan 2007!) to submit a checklist a day and the kinds of habitats they sometimes end up covering.

Birding after dark

If the sun has set and you still haven’t submitted your daily list, it’s not too late! Consider submitting a nocturnal bird count. Nocturnal counts are valuable too, as they help us understand where and when eBirders are finding owls, nightjars, and other species active at night. Or you may find no birds at all! That’s OK—lists with zero species are still welcomed in eBird. We recommend that you add some checklist notes indicating that you tried for birds and found none.

Every bird counts!

Your consecutive eBirding streak is prominently displayed on the home page. If you want the ultimate challenge (not required for this contest) see if you can really maintain a checklist-a-day for an entire year— or even longer! Your daily efforts may not always tally a lot of birds, but remember that as long as you are searching your hardest, complete checklists from busy streets, bad weather days, or at night all qualify.

While long lists and rare species are often the targets for a day of birding, the scientific value of an eBird list is not measured by the quantity or quality of the bird list . In fact, it is often the short counts from undersampled areas that are most valuable. One of the main scientific challenges with understanding eBird data is that effort tends to be concentrated around birding hotspots, rare birds, and certain types of habitats. If eBirders commit to following our best practices and participate in the “Checklist-a-day” challenge, we’ll help fill in the eBird maps for the blank spaces between eBird hotspots.

WINSTON-SALEM, N.C. (AP) — Trial in a federal lawsuit challenging North Carolina’s new voter identification law finally began on Monday, with a civil rights group alleging its photo requirement unlawfully harms Black and Latino voters.

The non-jury trial started more than five years after the state NAACP and several local chapters sued over the 2018 law, saying the photo requirement and two other voting-related provisions violate the U.S. Constitution — because lawmakers enacted them with discriminatory intent — and the Voting Rights Act.

The litigation, along with a similar lawsuit in state court, delayed implementation of the requirement until last year’s municipal elections. The 1.8 million voters who cast ballots in March primaries also had to comply. State election data showed that less than 500 provisional ballots were ultimately not counted in the primary because of ID-related issues.

The NAACP plaintiffs argue that some voters have already have been “caught up in the traps of the law” or were deterred from even coming to the polls in the first place, attorney Kathleen Roblez said during opening statements.

“This case is about impermissible and intentional racial discrimination,” Roblez told U.S. District Judge Loretta Biggs, adding the requirement “has already produced a discriminatory result for Black and brown voters,” who she said are less likely to hold qualifying IDs.

But an attorney representing Republican legislative leaders who helped enact the law said that it’s one of the most permissive voter ID requirements among states that have passed them, with free IDs available and exceptions for voters who can’t readily obtain one. Legislators passed the law over Democratic Gov. Roy Cooper’s veto mere weeks after voters approved a constitutional amendment directing a photo ID mandate.

“A legislature bent on discriminating would not have created all of these exceptions,” David Thompson, one of the GOP leaders’ lawyers, said in a Winston-Salem courtroom where the trial is expected to last several days. “The General Assembly was compelled by the people of North Carolina to enact a voter ID law.”

Biggs already has signaled that she won’t immediately rule from the bench. A favorable ruling for the NAACP could block the requirement in the fall. The November general election — with races for president, governor and other statewide seats — could see turnout three times greater than the primary. And the nation’s ninth-largest state is a likely presidential battleground where statewide races are often close.

Roblez said it is suspect to cite the constitutional amendment in justifying passage of the voter ID law because it was put on the ballot by General Assembly members at a time when many legislative districts were declared by federal judges to be illegal racial gerrymanders.

Roblez said the NAACP will present data showing Black and Latino voters are more than twice as likely to lack a qualifying ID with a photo than white voters. They plan to bring in witnesses who will say they encountered voting problems in the March primary. Thompson said that by total number, not percentage, there are more white voters who don’t have such an ID.

Thompson, who is representing House Speaker Tim Moore and Senate leader Phil Berger, and a state attorney representing the State Board of Elections members also defending the law in court said the rules impose only a minimal burden on voters.

The law greatly expanded the number of qualifying IDs compared to what was approved in a 2013 voter ID law used briefly until federal judges struck it down as discriminatory. Free IDs are provided by county election and Division of Motor Vehicles offices, and people lacking photo ID at the polls should have their votes count if they fill out an exception form or bring in their ID to election officials before the final tallies.

The GOP leaders also argue the General Assembly had legitimate state interests in passing the law: to build voter confidence in state elections and to prevent voter fraud. Still, nationwide voter identity fraud is rare.

State NAACP President Deborah Maxwell, the plaintiffs’ first witness, testified that the ID requirement makes it harder to vote and forced her group to allocate additional resources to make sure registered voters had a qualifying ID. She said free IDs from government offices only open on weekdays doesn’t help working people who only have weekends free.

Biggs, who was nominated to the court by President Barack Obama, issued a preliminary injunction in late 2019 blocking enforcement of the law, saying it was tainted because the 2013 law had been struck down on similar grounds of racial bias. But the 4th U.S. Circuit Court of Appeals reversed her decision , writing that she had put too much emphasis on the past conduct of the General Assembly when evaluating the 2018 law.

In a separate state lawsuit, the state Supreme Court last year upheld the 2018 law, which allowed the State Board of Elections to implement it months later. The now Republican-controlled court reversed a previous Supreme Court decision striking down the law when Democrats held a majority of the court’s seats.

Thirty-six states have laws requesting or requiring identification at the polls, 21 of which seek photo ID, according to the National Conference of State Legislatures.

EGLE partners with others to offer boat shrink-wrap recycling

The Michigan Department of Environment, Great Lakes, and Energy (EGLE) is partnering with the Michigan Recycling Coalition, Dr. Shrink, Bay Area Recycling for Charities and Emmet County Recycling to help keep boat shrink-wrap out of landfills, and you can help.

Shrink-wrap is used most commonly to insulate and protect boats for winter storage.

This year, boat shrink-wrap recycling is available at more locations in Michigan. New participants in the program include White Lake Township and the Charter Townships of Orion and Commerce, which are offering the program to their residents.

Last year, some 87,000 pounds of boat shrink-wrap was recycled under the Recycling Run program.
