Drunk driver in Michigan birthday party crash that killed young siblings, 4 and 8, charged with murder

An intoxicated driver was charged with murder after crashing into a Michigan business where a child's birthday party was being held and killing two young siblings, authorities announced Tuesday.

Marshella Chidester, 66, hit a building at Swan Boat Club in Berlin Charter Township around 3 p.m. on Saturday. It came to a stop 25 feet inside where the party was taking place, Monroe County Sheriff Troy Goodnough told reporters Saturday.

In an arraignment hearing Tuesday, Chidester was charged with two counts of second-degree murder, two counts of operating under the influence of alcohol causing death and four counts of operating under the influence of alcohol causing serious injury. Her bond was set at $1.5 million. If convicted, Chidester could be sentenced to up to life in prison.

Zayn Phillips, 4, and his sister, Alanah Phillips, 8, were declared dead at the scene, Goodnough said in an update Monday. The sheriff's office previously reported that Zayn was 5-years-old.

A third sibling survived with “severe injuries," according to Andrew Brodie, the superintendent of Flat Rock Community Schools, an area public school district.

At the arraignment, Bill Colovos, an attorney for Chidester, said she has a history of epileptic seizures in her legs and lost control of the car when she crashed. He also said that his client only had one glass of wine four hours before the crash, according to a search warrant executed at the bar where she allegedly was.

"This is not a monster," Colovos said about his client, adding that she doesn't have a criminal history. "It’s horrible what happened, absolutely horrible. I have two children. It's absolutely horrible. But some things we don’t have control over."

Chidester was seen in court with a cast on her right arm, wearing a striped white and black prison uniform.

Monroe County Prosecuting Attorney Jeffery A. Yorkey refuted the claim that Chidester had a seizure during the crash and said that "her blood alcohol level was significantly over the legal limit." He didn't mention what her blood alcohol level was.

"There is no indication, whatsoever, in any of the evidence that we have uncovered in this case, that the defendant suffered from a seizure at the time of this incident," Yorkey said during the hearing.

"She indicated herself that she had some seizure issues and she was on some medication, and that she wasn't supposed to be drinking, but admitted that she had been drinking that day," Yorkey said.

A woman who identified herself as the grandmother of Zayn and Alanah spoke at the arraignment, accusing Chidester of drinking and driving.

"She chose to drink and drive and she took my grandbabies from us," the woman said.

A woman who identified herself as the aunt of the two children said she was at the scene of the crash, and saw her niece and nephew in their final moments.

"They walked into that birthday party having a fun time," she said. "They were sitting at that table, eating, and this woman crashed her car through this building, destroying all of our lives. Not just my family, everyone else that was in that building."

She says her other nephew and her sister, the children's mother, were hurt in the crash and are still fighting for their lives.

"I had to be the one to tell my sister her babies were gone when they removed her ventilator yesterday," the woman said. "She said 'How am I supposed to live without my babies?'"

"No one should ever have to go to a birthday party thinking that they’re gonna die," she said tearfully.

Zayn's birthday was coming up next month, according to Monroe County Undersheriff Joe Hammond.

"We were supposed to be planning a birthday party for Zayn, not a funeral," the child's aunt said.

Approximately 13 others were injured in the crash, Goodnough said on Saturday. Nine of those people, who range in age from 11 to 66-years-old, were hospitalized, according to the Monroe County Sheriff’s Office.

Five remain in critical condition, including an 11-year-old boy, a 14-year-old boy, a 16-year-old girl, an 18-year-old woman and a 31-year-old woman.

The four other victims, who range in age from 57 to 70, had minor injuries. A 42-year-old man also received treatment on his own for minor injuries.

Chidester's next court appearance is scheduled for April 30.

Black's Island is located in Saint Joseph Bay and just south of Port St. Joe on Florida's panhandle. The island was named for Samuel "Black Sam" Bellamy, who is known as the wealthiest pirate in history.

The island hosts its own private resort, complete with 26 waterfront bungalows as well as common areas like a clubhouse, cabana, and pool, according to the sale listing. The structures are connected via an elevated boardwalk that runs along the center of the island.

Black's Island currently hosts short-term rentals with the help of a management company and full-time staff on the island, which is accessible via a 10-minute boat ride from the mainland, or by seaplane and helicopter.

From the dock on the mainland, the Panama City Beach International Airport is an hour-and-twenty-minute drive away. A smaller airport for those flying in on a private jet is only 25 minutes away.

"You're only 3 miles off the mainland, and you seriously feel like you're in the islands," Lori Bembry Weldon, one of the listing brokers at Jon Kohler & Associates, told Business Insider, adding, "It's really super cool. There's just nothing like it on the coast of Florida that's available."

If you can't quite swing the $50 million price tag, you may still have a chance to get a slice of the island life .

In addition to listing the entire island for sale, the owner has also listed several of the individual bungalows . Weldon said the owner, Atlanta developer Scott Seymour, is open to selling the entire island or just some of the bungalows — so it will ultimately depend on what potential buyers are interested in.

In this scenario, Weldon said the setup would be similar to a condo homeowners' association. The bungalows, which start at $1.5 million, would be purchased under a 99-year lease, and there would be a $25,000-a-year HOA fee to cover taxes, insurance, repairs, and utilities, including upkeep for all the common areas.

Weldon also said in the case of individual bungalow sales, pre-approved title insurance and lenders have already been set up, so potential buyers would not have to worry about getting insurance — an increasing problem in Florida .

The bungalows, which were first built in 2009, were remodeled when Seymour bought the island in 2018. Weldon said that in addition to renting out the bungalows, he also frequently spends time on the island.

Seymour is also currently building a $20 million hotel on the mainland where anyone who purchases a bungalow will be able to park. The hotel is also set to be named after the infamous pirate and will be called The Bellamy.

France accused of ‘irresponsible’ actions after Channel migrants die

MPs condemn actions of police for allowing flimsy dinghy crammed with 112 people to continue crossing to UK

France has come under fire for allowing a migrant boat on which five people were crushed to death to continue its journey across the Channel to Britain.

French police permitted the flimsy dinghy, crammed with an unprecedented 112 migrants, to leave the Plage des Allemands beach at Wimereux, near Boulogne, at 6am on Tuesday. The scene was witnessed by a BBC reporter.

A seven-year-old girl, a woman and three men died in a crush on the heavily laden boat after panic broke out when the engine cut out several hundred yards from the shore, police said.

Forty-eight of the migrants were taken to the shore by France, but 58 remained on board after refusing to leave the boat and were allowed to continue their journey to Britain, escorted by a French navy ship.

The French approach led to a backlash on Tuesday. Tim Loughton , a former minister and a member of the home affairs committee, said: “This is incredibly irresponsible behaviour by the French authorities on so many levels after another avoidable tragedy.”

He said France should not have allowed such an overloaded dinghy to leave the beach and should have impounded it and brought all the migrants ashore when they discovered the tragedy at sea.

“Why was the whole boat and passengers not impounded as a potential crime scene with dead bodies on board?” he asked.

Natalie Elphicke , the MP for Dover, said she was “deeply saddened” by the loss but that there needed to be a new comprehensive UK-French agreement across the Channel to intercept boats and take them back to the French coast.

“It is irresponsible to allow people to set off in these dangerous, unsafe boats,” she added.

The deaths came hours after Parliament finally passed Rishi Sunak’s Safety of Rwanda Bill into law, paving the way for the first deportation flights aimed at deterring the Channel crossings.

On Monday, Home Office figures showed that the number of migrants arriving by small boats across the Channel had increased by 24 per cent to 6,265 in the first four months of this year , compared with 5,049 last year.

Mr Sunak said that criminal gangs were exploiting the vulnerable and “packing more and more people into these unseaworthy dinghies”.

Border Force officials said that French police were seizing more boats before they reached the sea, which meant smugglers were cramming more migrants on boats.

During Monday night, French police officers had intercepted two boats, two fuel cans, two engines and life jackets before they could be used to put migrants to sea.

The number of migrants on small boats have doubled in the past two years to an average of between 50 and 60 – with a few carrying as many as 80.

Andrew Harding, the BBC reporter who witnessed the dinghy leaving, said: “Once the migrants had boarded the inflatable boat they’d been dragging across the sand, the police made no further attempt to stop them.”

The French authorities’ interpretation of maritime law means that they will not stop or turn back the migrants at sea unless the asylum seekers request assistance because of the risk to life if they try to intervene.

Jacques Billant, the prefect of Pas-de-Calais, said the 58 migrants had remained on the boat after refusing to be rescued. “They managed to restart the engine and decided to continue their sea route towards Great Britain under the surveillance of the French Navy,” he said.
