Integrity and the relentless pursuit of the deal defines Moran Yacht & Ship - I am grateful that you were on this journey with me. This magical machine KISMET is the second yacht I’ve had built with Moran Yacht & Ship. KISMET has brought joy, hope, and the gift of discovery to many lives - including my own. You have made this world a better place! Owner, KISMET
By way of background, my business interests include controlling stakes in 3 publicly traded companies which operate vessels in the 500 to 5000dwt range. On average, one new vessel a year would be added to the fleet. As a result, I have access to in-house marine architects, engineers and construction supervisors. Consequently, when I decided to build my first large motor yacht, I did not feel I needed the services of a company like Moran Yacht & Ship. In any event, I was persuaded to let them negotiate on my behalf while I simultaneously held discussions with other building options. Moran Yacht & Ship understands yachts, their incredibly complex systems, and what constitutes a practical solution to various owners’ ideas. In short, I would not consider building another yacht without engaging Moran Yacht & Ship to provide the services they are so good in delivering. Former Owner, NORTHERN STAR

Yacht docked in US port symbolizes struggle to convert seizures into cash for Ukraine

  • By Matthew Kupfer
  • Oleksii Kovalenko

Natasha Mozgovaya

FILE - The superyacht Amadea sails into the San Diego Bay June 27, 2022, seen from Coronado, California.

When a superyacht worth $230 million pulled into the port of Everett, Washington, for repairs last month, it made a big splash in the city of 110,000 residents.

The 106-meter luxury behemoth known as the Amadea is currently in possession of the U.S. government, which alleges the yacht belongs to sanctioned Russian oligarch and politician Suleyman Kerimov, an ally of Russian President Vladimir Putin.

Looking out over the port, Everett resident Bob Templeton wondered who was paying for the superyacht's upkeep. “They ought to sell it to somebody and get a lot of money,” he told VOA with a laugh.

Easier said than done. Templeton’s offhand remark cuts to the core of a dilemma faced by the United States as it attempts to use sanctions to rein in Russian aggression against Ukraine.

FILE - Russian billionaire Suleyman Kerimov watches a soccer match at Lokomotiv stadium in Moscow, Russia, Aug. 23, 2012.

The U.S. government has moved to take ownership of the Amadea through a legal procedure called civil forfeiture. The end goal is to sell the vessel and transfer the proceeds to Ukraine.

But another Russian businessman, who is not under sanctions, has challenged that move, claiming that he is the Amadea’s true owner.

As the courts try to sort out the yacht’s ownership, U.S. taxpayers are footing the bill: over half-a-million dollars a month for maintenance.

And the complex legal battle could drag on for a long time, increasing the costs for the U.S. and delaying any benefit to Ukraine from the yacht’s seizure, according to Stefan Cassella, a former U.S. federal prosecutor and expert in civil forfeiture.

“Nobody who is a sanctioned oligarch owns anything in his own name,” he said. “You have an entire zoo of third parties who claim they own the property.”

Kerimov did not respond to a request for comment. The U.S. Department of Justice declined to comment.

Kleptocapture win

In May 2022, just months after Russia launched its full-scale invasion of Ukraine, law enforcement in Fiji seized the Amadea at the request of the U.S. government.

That was a major victory for Task Force Kleptocapture, a unit of the U.S. Department of Justice created in the wake of the Russian invasion to enforce sanctions.

But completing the job has proved more complicated.

Since the 1980s, civil forfeiture has been the Department of Justice’s go-to tool for targeting drug dealers, the mafia and money laundering operations, according to David Smith, a former DOJ prosecutor who pioneered the practice.

It allows law enforcement to seize assets without convicting their owner of a crime. All that prosecutors must prove is that the assets were used in a crime, profited from a crime or resulted from criminal activity.

But when that crime is a sanctions violation, proving the asset is owned by a sanctioned person is critical.

Lawyers representing the company that owns Amadea have claimed the yacht actually belongs to Eduard Khudainatov, a former CEO of the Russian state oil company Rosneft, who is not subject to sanctions.

FILE - Eduard Khudainatov, formerly of Russian state oil company Rosneft, is seen outside Moscow, Sept. 4, 2010. (Presidential Press Service via AP)

He and his legal team say the seizure is unlawful and based on a “misleading” FBI affidavit.

“Eduard Khudainatov is, and always has been, the rightful owner of the Amadea. The Biden Administration’s unconstitutional seizure of the vessel was based on demonstrable falsehoods that we will establish in court,” his spokesperson said in a statement to VOA. “The government asserts factual and legal theories that are divorced from forfeiture sanctions and money laundering laws, and unsupported by the cases interpreting those laws. This boondoggle is nothing more than political theater that has cost American taxpayers more than $20 million to date.”

The U.S. government disagrees, referring to Khudainatov as a “straw owner” of the Amadea.

According to prosecutors, Khudainatov is “supposedly the beneficial owner of at least eight yachts or yacht projects” — a fleet valued at over $1 billion. They include a yacht that prosecutors state is actually owned by Igor Sechin, the sanctioned incumbent CEO of Rosneft and a Putin ally.

Journalists have linked another one of the superyachts, the Scheherazade, to Putin himself. In May 2022, it was impounded in Italy .

While Khudainatov’s lawyers were unable to prevent the Amadea's transfer to the United States, they are currently fighting forfeiture in a New York court.

The DOJ states that Kerimov purchased the yacht in 2021, three years after he was added to sanctions list. Prosecutors allege that the oligarch or his proxies routed dollar transactions through U.S. financial institutions to maintain the Amadea, which would constitute a sanctions violation.

But proving Kerimov’s ownership — and disproving Khudainatov’s claim — is no simple task.

Assets like superyachts are often owned through a series of proxy owners, offshore companies and trusts. These entities are often registered in jurisdictions chosen for their secrecy.

Cassella, who has studied the case, says that Khudainatov’s legal team is dragging out proceedings, while the U.S. government is trying to compel him to answer questions and provide documentation that would prove he is not the Amadea's owner.

“This is civil forfeiture defense 101 for anybody who’s got an infinite amount of money to pay lawyers to oppose the forfeiture,” Cassella said.

Expensive process

While the legal battle goes forward, the U.S. government is paying to keep the Amadea running.

According to court filings, upkeep of the yacht costs roughly $600,000 a month. Insurance costs another $144,000 monthly, and there are other periodic expenses.

In a February filing, an official of the U.S. Marshals Service stated that the Amadea was also scheduled to undergo drydocking in March, which appears to have been delayed.

That procedure, which involves removing a vessel from the water to conduct repair work, was estimated to cost $5.6 million — although the government negotiated not to pay the other monthly costs during that period, the official noted.

In recent months, however, the U.S. government has taken steps to decrease the cost.

In February, it petitioned the court to sell the Amadea, citing the excessive costs of maintaining the yacht. Such a sale would effectively convert the yacht into cash, but not settle the ownership question.

In a filing opposing the sale, Khudainatov’s legal team stated that he had consistently offered to cover the cost of maintaining the Amadea.

On May 17, the U.S. government also submitted a motion to reject Khudainatov’s ownership claim, stating that he lacks standing to contest forfeiture.

If a judge agrees, that could allow the forfeiture to proceed.

Controversial, challenging strategy

While confiscating the assets of Russian oligarchs and top officials may not face fierce opposition from most Americans, civil forfeiture is controversial in the United States.

Advocacy organizations, both liberal and conservative, have criticized the practice, arguing that it allows law enforcement to seize private property without convicting the owner of a crime.

Smith, the former DOJ prosecutor, says the burden falls hardest on low-income Americans who struggle to pay for a lawyer.

This was one of the reasons why eight members of the U.S. House of Representatives in April 2022 voted against a bill calling for the Biden administration to seize sanctioned Russians’ assets to fund Ukraine.

Smith believes applying civil forfeiture to oligarchs is “arbitrary” and he is unsure whether the U.S. will be able to seize enough assets from oligarchs to make a meaningful difference for Ukraine.

“I would rather spend the money [subsidizing forfeiture investigations and proceedings] on other things than trying to forfeit these yachts,” he said. “And who knows how many will ultimately be forfeited.”

That concern is not unfounded. The Kleptocapture Task Force is working to forfeit or restrain around $700 million , but, so far, the United States has been able to transfer forfeited assets to Ukraine in only a handful of cases.

In May 2023, U.S. Attorney General Merrick Garland authorized sending $5.4 million to Ukraine that the U.S. had seized from sanctioned Russian oligarch Konstantin Malofeyev. It represented the first such transfer of forfeited funds to Ukraine.

U.S. Attorney General Merrick Garland authorizes the payment of an unspecified amount to the Kyiv government, money he said the U.S. seized from Russian oligarch Konstantin Malofeyev.

US Sends Ukraine Cash Seized From Russian Oligarch

Later that year, the U.S. transferred over a million rounds of ammunition to Ukraine after seizing them en route from Iran to Yemen.

In February 2024, the U.S. government, after breaking up a scheme to illegally procure military-grade technology for Russia, transferred $500,000 in forfeited Russian funds to Estonia to provide aid to Ukraine.

In April, the U.S. transferred another shipment of weapons seized from Iran to Ukraine.

Those transfers put funds and ammunition in the hands of the Ukrainian government, but they were also of a significantly lower value than the Amadea.

Bigger cases involving oligarch assets may prove more difficult.

“It wouldn’t surprise me if it took 10 years to resolve some of these cases,” said former prosecutor Cassella.

Natasha Mozgovaya reported from Everett, Washington. Matthew Kupfer and Oleksii Kovalenko reported from Washington, D.C.

Russian Disinformation Videos Smear Biden Ahead of U.S. Election

Many of the videos are trying to appeal to right-wing voters with fake messages about President Biden, experts say.

  • Share full article

A wide cityscape of buildings in Moscow.

By Julian E. Barnes and Steven Lee Myers

Julian Barnes, who covers U.S. intelligence agencies, and Steven Lee Myers, who covers misinformation, have been reporting on Russian efforts to influence the 2024 presidential election.

Last month, a video began circulating on social media purporting to tell the story of an internet troll farm in Kyiv targeting the American election.

Speaking in English with a Slavic accent, “Olesya” offers a first-person account of how she and her colleagues initially worked in support of President Volodymyr Zelensky of Ukraine. Then, she says, after a visit by mysterious Americans who were “probably C.I.A.,” the group began sending messages to American audiences in support of President Biden.

“We were told our new target was the United States of America, especially the upcoming elections,” the woman in the video says. “Long story short, we were asked to do everything to prevent Donald Trump from winning the elections.”

The video is fake, part of an effort to cloud the political debate ahead of the U.S. elections.

U.S. officials say the video is consistent with Russian disinformation operations as internet warriors aligned with Russia appear to be honing their strategy. Some of the old tactics of 2016 or 2020 could be used again, with new refinements.

An analysis of the video done by U.S. intelligence agencies found that the voice of “Olesya” was synthetically generated, an intelligence official said Thursday, a potential sign of how Russian operatives are blending new techniques with old tactics.

While there has been much hand-wringing over the role that artificial intelligence could play this year in fooling voters, current and former officials said that videos were one of the most immediate threats.

Microsoft said the video featuring “Olesya” probably came from a group it calls Storm-1516, a collection of disinformation experts who now focus on creating videos they hope might go viral in America.

The group most likely includes veterans of the Internet Research Agency, a Kremlin-aligned troll farm that sought to influence the 2016 election. The agency was run by Yevgeny Prigozhin, the founder of the Wagner mercenary group who led a rebellion against the Kremlin and then was killed in a plane crash that American and allied officials believe was orchestrated by Russian intelligence agencies.

Microsoft said the group also included people associated with Valery Korovin, the figurehead of an obscure Moscow-based think tank called the Center for Geopolitical Expertise, a conservative organization affiliated with Aleksandr Dugin, an ultranationalist writer who faces U.S. sanctions for his role in recruiting fighters for the war.

Russian operatives are leaning into videos, many of them that falsely purport to be made by independent journalists or whistle-blowers. The videos, opposed to blog or social media posts, are more likely to spread beyond the conspiratorial fringes of America and become part of mainstream discourse.

On Wednesday afternoon, Avril D. Haines, the director of national intelligence, told the Senate Intelligence Committee that Russia was the most active threat to the coming election. Russia, she said, tries to erode trust in democratic institutions, exacerbate social divisions and undermine support for Ukraine.

“Russia relies on a vast multimedia influence apparatus, which consists of its intelligence services, cyberactors, state media proxies and social media trolls,” she said. “Moscow most likely views such operations as a means to tear down the United States.”

China has a sophisticated influence operation and is increasingly confident in its ability to affect election results, Ms. Haines said. But she added that the intelligence community assessed that China did not try to influence the 2020 presidential election, and that so far there was no information that China would be more active in this year’s contests.

Senator Mark Warner, Democrat of Virginia and the chairman of the Intelligence Committee, said that adversaries had a greater incentive than ever to intervene in elections but that the public had too often treated such meddling “as trivial or quaint.”

Clint Watts, the general manager of Microsoft’s Threat Analysis Center, said pushing out written disinformation with bots was largely a waste of time — in 2024 it is disinformation video that has the best chance of spreading with American audiences.

The C.I.A. video, Mr. Watts said, was a classic Russian tactic: accuse your adversary of the very thing you are doing. “When they say there’s a troll farm operated by Zelensky in Ukraine going after the U.S. election, what they’re saying is this is what we’re doing,” Mr. Watts said.

Walter Trosin, a spokesman for the C.I.A., said the agency was not involved in the activities described in the video.

“This claim is patently false and precisely the type of disinformation that the intelligence community has long warned about,” Mr. Trosin said. “C.I.A. is a foreign-focused organization that takes our obligation to remain uninvolved in American politics and elections very seriously.”

At the Senate hearing, Ms. Haines praised the C.I.A. for calling out the video publicly, saying it was an example of how the government will identify disinformation by Russia or other countries during the current election.

Multiple groups in Russia push out disinformation aimed at America . In addition to the videos, researchers and government officials say, Russia has created a handful of fake American local news sites and is using them to push out Kremlin propaganda , interspersed with stories about crime, politics and culture.

Gen. Paul M. Nakasone, who retired from the Army this year and is the former director of the National Security Agency, said the best defense to Russian disinformation remained the same: identifying it and publicizing the propaganda push. The United States, he said, needs to expand its information sharing both domestically and around the world so people can identify, and discount, disinformation spread by Moscow.

“The great antidote to all of this is being able to shine a light on it,” said General Nakasone, who last week was named as the founding director of Vanderbilt University’s new Institute for National Defense and Global Security. “If they are trying to influence or interfere in our elections, we should make it as hard as possible for them.”

Some mainstream Republicans have already warned fellow lawmakers to be wary of repeating claims that originated in Russian disinformation or propaganda.

“We see directly coming from Russia attempts to mask communications that are anti-Ukraine and pro-Russia messages, some of which we even hear being uttered on the House floor,” Representative Michael R. Turner, an Ohio Republican who is the chairman of the House Intelligence Committee, told CNN’s “State of the Union” on April 7.

Russia’s information warriors have pushed fake videos to spread lies about Ukraine , aimed at undermining its credibility or painting it as corrupt. Republican politicians opposed to sending more aid to Ukraine have repeated baseless allegations that Mr. Zelensky has tried through associates to buy a yacht, disinformation that first appeared on a video posted to YouTube and other social media sites.

Most of the videos produced by Storm-1516 fail to get traction. Others come close. A video pushed out on a Russian Telegram channel purported to show Ukrainian soldiers burning an effigy of Mr. Trump, blaming him for delays in aid shipments.

The video was highlighted on Alex Jones’s right-wing conspiracy site, InfoWars, and other English-language outlets. But it was quickly discounted — the purportedly Ukrainian soldiers had Russian accents and were masked.

“This campaign has been working to advance some of Russia’s key objectives, particularly that of portraying Ukraine as a corrupt, rogue state that cannot be trusted with Western aid,” Mr. Watts said.

Since last August, Microsoft has identified at least 30 videos produced by Storm-1516. The first ones were aimed at Ukraine. But others are trying to influence American politics by appealing to right-wing audiences with messages that Mr. Biden is benefiting from Ukrainian assistance.

Intelligence officials, lawmakers and security firms have warned about the use of artificial intelligence by China, Russia and other nation states intent on spreading disinformation. But so far, Russian groups like Storm-1516 have mostly avoided using A.I. tools, according to security firms.

“Many of the A.I. campaigns are easy to detect or unwind,” said Brian Murphy, the general manager of national security at Logically, which tracks disinformation. “A.I. is getting better, but it is still not at the stage this year wherein it is going to be used at the scale and with the quality some predict. Maybe in a year or so.”

Both government officials and outside experts, however, have said that A.I.-altered audio had proved more effective than altered videos. At the hearing on Wednesday, Ms. Haines highlighted a fake audio recording released in Slovakia two days before its parliamentary election. While quickly identified as fake, news and government agencies struggled to disclose the manipulation and the target of the fake recording lost a close election.

Outside experts have said that artificial intelligence has been used in some Russian propaganda videos to obscure accents. It is not clear exactly why a synthetic voice would have been used in the fake video of the C.I.A. troll farm.

But on Wednesday, Ms. Haines said artificial intelligence and other innovations “have enabled foreign influence actors to produce seemingly authentic and tailored messaging more efficiently at greater scale and with content adapted for different languages and cultures.”

For now, though, basic videos like the C.I.A. troll farm or yacht video that purport to have authentic narrators with access to exquisite information are the most prevalent threat.

In 2016, Russian-controlled propagandists could push out fake news articles or social media posts and, in some cases, have an impact. But now, those old techniques do not work.

“No one will pay attention to that nowadays,” Mr. Watts said. “You have to have a video form to really grab an American audience today, which 10 years ago was just not even technically that possible.”

Ukraine war latest: Armed ship destroyed in Crimea, Kyiv says; controversial US television host launches show in Russia

Ukraine says it hit and destroyed the Russian missile ship Tsiklon in Crimea over the weekend. Meanwhile, analysts say Moscow is seeking to draw out Kyiv's forces - as Putin makes another significant change to his cabinet.

  • Big picture: What you need to know as war enters new week

Our live coverage will remain paused today, but let's catch you up on where things stand and on any updates overnight.

  • Russia said 35 rockets and three drones were fired into Belgorod and overnight, claiming to have destroyed all of them;
  • Blasts were heard in Kherson as Russia shelled the city, said its regional governor Roman Mrochko;

  • A Russian airstrike on Ukraine's northeastern city of Kharkiv yesterday destroyed a cafe, damaged a nearby residential building and set a petrol station ablaze, with local officials saying ten people were wounded.

As we've not been providing rolling coverage of the war in Ukraine today, here is a quick update on what's been happening since this morning.

One of the most significant new stories is the UK accusing China of providing or preparing to provide lethal aid to Russia for use in the war against Ukraine.

Defence Secretary Grant Shapps told a news conference this morning that US and British defence intelligence had evidence "lethal aid is now, or will be, flowing from China to Russia and into Ukraine".

He called this a "significant development".

We also heard from the Kremlin this morning, which said "in-depth dialogue" was needed to reduce rising tensions between Russia and the West - particularly with regards to nuclear issues.

Kremlin spokesperson Dmitry Peskov accused the "collective West" of refusing to engage with Russia despite the potential dangers.

Here are more of the top stories:

  • Russian forces have taken over the village of Klishchiivka in Ukraine's eastern Donetsk region, close to the city of Bakhmut, according to Russian news agencies
  • At least nine people have been injured in a Russian air attack on the Ukrainian city of Kharkiv
  • Russia accused Ukraine of using a drone to attack a non-nuclear facility at the Zaporizhzhia nuclear plant, causing no critical damage
  • Moscow said it is bolstering its efforts to protect its energy infrastructure from drone attacks
  • Six children were handed over to Ukraine by Russia and reunited with their families, after a deal was brokered by Qatar.

We're pausing our coverage of the Ukraine war for the moment.

Scroll through the blog below to catch up on today's developments.

Vladimir Putin has praised the late president of Iran, Ebrahim Raisi, and said he was a "reliable partner".

Raisi was killed in a helicopter crash near the Azerbaijan border over the weekend along with his foreign minister and seven others.

Speaking on the leader, Mr Putin said he was "a man of his word" who carried out any agreements the pair made.

"He was truly a reliable partner, a man sure of himself, who acted in the national interest," Russian news agencies quoted Mr Putin as telling Vyacheslav Volodin, chairman of Russia's lower house of parliament.

"He was, of course, a man of his word and it was always good to work with him. What I mean is if we came to an agreement on something, you could be sure the agreement was carried out."

The Kremlin leader asked Mr Volodin, who will be attending memorial events in Iran, to pass on "words of our sincere condolences in connection with this tragedy".

Since the start of the war in Ukraine, Russia has strengthened political, trade and military ties with Iran in a deepening relationship that the US and Israel view with concern.

Heavy fighting in the Pokrovsk area in eastern Ukraine has forced Ukrainian troops to engage in "manoeuvres," the Ukrainian military's general staff have said.

Their report said Pokrovsk, northwest of the Russian-held city of Donetsk, remains the front's "hottest" sector.

"In some areas, the situation requires our troops to engage in manoeuvres," the general staff report reads.

Volodymyr Zelenskyy has referred to the region and adjacent areas as "extraordinarily difficult" in his nightly video address.

Volodymyr Zelenskyy has said allies are taking too long when it comes to decisions on military support for Ukraine.

In an interview with Reuters, the Ukrainian leader said every decision which everyone came to was "late by around one year".

"But it is what it is: one big step forward, but before that two steps back. So we need to change the paradigm a little bit," he said.

"When we're quick, they fall behind. And then there's a gap - six, eight months of unpassed (aid) packages, and then two-three months of supplies - and a year goes by. We would like not to lose the advantage."

Mr Zelenskyy also said Ukraine had never used Western weapons on Russian territory.

A senior Russian diplomat has said that the EU plan to channel profits from frozen Russian assets to Ukraine would have "unpredictable" consequences, according to the TASS news agency.

According to TASS, Kirill Logvinov, Russia's acting permanent representative to the EU in Brussels, told Russia journalists: "The only predictable thing is that those in the EU will be obliged sooner or later to return to our country what has been stolen."

For context : In March the European Commission proposed transferring to Ukraine profits generated by Russian central bank assets frozen in Europe.

The plan would see 90% channeled through the European Peace Facility fund to buy weapons for Ukraine.

The rest would be used for recovery and reconstruction.

Russia's defence ministry has said it has begun a round of drills involving tactical nuclear weapons.

The exercises were announced by Russian authorities this month in response to remarks by senior Western officials about the possibility of deeper involvement in the war in Ukraine.

It was the first time Russia has publicly announced drills involving tactical nuclear weapons, although its strategic nuclear forces regularly hold exercises.

According to the ministry's statement, the first stage of the new drills include nuclear-capable Kinzhal and Iskander missiles.

The maneuvers are taking place in the southern military district, which consists of Russian regions in the south.

A Moscow court has ordered a Russian journalist who covered the trials of the late Russian opposition politician Alexei Navalny and other dissidents must  remain in custody pending an investigation and trial on charges of extremism.

Antonina Favorskaya was arrested in March.

She is accused of collecting material, producing and editing videos and publications for Navalny's Foundation for Fighting Corruption, which had been outlawed as extremist by Russian authorities, according to court officials.

Today, Moscow's Basmanny district court ordered that she remain in custody until at least 3 August.

Kira Yarmysh, Navalny's spokeswoman, said earlier that Ms Favorskaya did not publish anything on the foundation's platforms and suggested that Russian authorities have targeted her because she was doing her job as a journalist.

Former Fox News presenter Tucker Carlson has launched his own show in Russia.

The controversial US media personality, who this year became the first Western journalist to interview Vladimir Putin since Russia invaded Ukraine, will host his show on the state-owned Russia 24 (Rossiya 24).

In the first episode, Carlson will discuss the dangers of ticks and Lyme disease.

Who is Carlson?

Carlson, who has been a vocal supporter of Mr Putin in the past, was sacked from Fox News in April last year.

He took up the prime-time weekday evenings spot on Fox News in 2016 with his show Tucker Carlson Tonight, and quickly established himself as a key player in the network and an influential voice in Republican politics.

The presenter often embraced conspiracy theories and far-right issues. He repeatedly questioned the efficacy of COVID vaccines and compared mandates to "Nazi experiments".

While he found success with viewers, his inflammatory comments caused some advertisers to distance themselves from the programme.

After his departure from Fox News he rebooted his show on X last year, calling Elon Musk's site the last big remaining platform to allow free speech.
