Explanation Deposit Insurance:

Basically all charter bases insure the yachts of their fleets with both third party liability insurance and hull insurance. Simply put, the liability insurance covers damages to other boats, port facilities or strangers. The comprehensive insurance covers damages of the chartered yacht – for hull insurance, there is always a deductible. For this excess that is not covered by the hull insurance, the charterer pays a security deposit.

We always recommend to secure this deposit with a deposit insurance. In some cases, the charter companies offer an own insurance with a “damage waiver”: Buying the non-refundable damage waiver, charterer pay less refundable deposit. But with most charter bases, a deposit insurance with an insurance company is recommended.

Other recommended charter insurances are:

– Skipper’s third party liability insurance

– Charter cancellation insurance – just in case the skipper or crew members become ill

– International travel health insurance, eventually accident insurance

Travel Cancellation Insurance and Travel Health Insurance are recommended as well for guests travelling with Crewed Charters / Luxury Yacht Charters.

Chartering Your Boat

Many boat owners choose to charter their craft to help with mooring costs or simply to keep the boat in working order whilst they are away. But like letting out your home or even your car, you’d expect your property to be looked after and for your insurance to cover you for any incidents which happen beyond your control.

Chartered Yacht

You can charter your boat in two ways – either with or without skipper and crew (referred to as a bare boat charter). In this article we will focus on bare boat charters as this scenario is higher risk and requires more care on the part of the yacht owner.

If you do intend on charting your boat, you should ensure that it’s in good shape before you do so. Depending on the type and location of your craft you’ll need to get ‘coded’. Most craft will be subject to Maritime and Coastguard Agency (MCA) coding which your craft must obtain before you’re able to charter it. If you own a narrow boat or other inland craft however, you will be subject to the rules and regulations of the Canal & River Trust in England & Wales or Scottish Canals if operating in Scotland. Similarly, some local areas (The Solent for example) will impose their own coding.

MCA coding will certify that your vessel has been thoroughly checked for seaworthiness and that all the required safety features on board are present and in good working order. These include first aid kits, lifesaving equipment and distress signals (e.g. flares).

Who should you allow on your boat?

It’s always down to your discretion who you let loose with your boat. However, we would recommend you stick to the following tips to ensure that your potential customers are competent, honest and sensible.

One or more of your charterers must be RYA coastal skipper qualified - This is an insurance requirement as well as a requirement of many port authorities

Do not take cash payments - Taking card payments or bank transfers will allow you some security should someone abscond with your craft

Lay down the ground rules – Particularly if you’re going to allow groups on board, you should enforce ground rules on subjects like alcohol early

Enforce point three by having your charterers sign a “Bareboat charter agreement” – This will protect you should the charterers be responsible for any damage or negligence on their part. See a template for a bareboat charter agreement .

Ensure charterers have their own personal injury cover – it is not your responsibility to insure against injuries sustained by charterers aboard your craft. It is therefore essential that charterers hold their own personal injury cover.

Chartered yacht insurance requirements

In order to charter your yacht you’ll need to have a private and pleasure policy with a bareboat charter extension. In this policy extension you’ll find the relevant conditions which apply to you and your charterers.

The basis of this extension covers off several of the points mentioned above. Charterers must be RYA coastal skipper qualified , you must not take cash payments and you should take down the charterer’s passport number, driving license number and current home address.

The RYA agreement mentioned above also stipulates the responsibilities of both the operator and the charterer. Section seven of the RYA charter agreement explains in detail that the operator will insure the boat against fire, collisions and indemnity of at least £2million and also makes it very clear that the operator shall not be liable for any personal injury sustained by the charterer whilst on board.

It is recommended that whether you’re an operator or charterer you read these documents and have an understanding of your responsibilities.

Once you earn no claims bonus it is protected. This means that you will not lose your no claims bonus if you have one claim in any one policy period. Two or more claims will result in a loss of no claims bonus.

We cover you and any other person using your Yacht with your permission for legal liability to another person arising out of interest in use of your Yacht up to a maximum of £5,000,000.

We include single handed sailing cover for up to 18 consecutive hours at no extra charge.

We cover your legal expenses up to £25,000 to pursue damages for injury or death or out of pocket expenses following damage to your Yacht or for the defence of criminal prosecutions brought against you.

We cover you and the crew of your Yacht for Medical Expenses incurred by you and/or them arising out of personal injuries caused by any of the perils covered under your Yacht Insurance up to £1,000 any one occurrence.

Our Yacht Insurance covers you and any other person using your Yacht with your permission for accidental bodily injury or death whilst using your Yacht up to a maximum amount of £20,000 any one person and £40,000 in respect of any one event.

Our staffed emergency claims helpline is open 24 hours a day, 365 days a year so we’re always there when you need us to offer a swift response and give sound, practical advice.

Once we have received invoices and bank account details it takes 3-5 working days to be processed through the banking system and to arrive in the recipients bank account.

What is covered in a superyacht insurance policy?

Superyacht insurance will typically include ‘all-risks’ cover for protection against physical loss or damage to the hull machinery and equipment, and a wide spectrum of third-party liability covers. Liability insurance can cover damage to other vessels and property, and injury to people both on board and off the yacht, including crew members.

Specific cover for the captain and crew includes personal accident cover and emergency medical expenses cover (with options to include elements of routine medical cover), and lump sum and/or weekly benefit payments in the event of specified injuries and/or death (crew welfare insurance).

Insurance cover for your yacht can extend to the vessel’s inventory, dinghies, accessories, fishing gear and personal effects. In addition, we can provide cover to protect your yacht when in build or undergoing an extensive refit programme, as well as whilst she is in transit.

When skippering a boat that is not your own, the responsibility to yourself, your crew, passengers and to third parties is just as great as if you were skippering your own boat. With the Pantaenius Skipper Third Party Liability policy those who skipper rented or chartered boats can now protect themselves against unexpected financial or legal burden incurred as a consequence of accidental damage or injury to a third party.

The Pantaenius Skipper Third Party Liability Insurance policy covers the skipper for legal liabilities to third parties arising out of an accident whilst they are skippering a boat they do not own. The policy comes into effect when the boat’s own liability insurance either does not exist or cannot be applied.

Does this insurance cover me for damage I cause to the yacht I am skippering?

If this insurance does not cover me for damage i cause to the yacht i am skippering, then what is it for.

It is important to note that the Skipper Third Party Liability policy is a contingent liability cover only, designed to cover those personal liabilities a skipper may incur through use of a yacht they do not own and for which the yacht’s own liability insurance somehow fails to respond.  It does not cover damage caused to the yacht you are skippering and it is not a skipper’s Professional Indemnity policy. In layman’s terms think of it as a yachting equivalent of a “driving other cars extension” that you might sometimes find on a motor insurance policy, i.e., under a driving other cars extension you would have third party liability cover while driving another car that you did not own, but there would be no cover for loss or damage to the driven vehicle, nor any liability you may face to the car’s owner for loss or damage to their vehicle.  Where our Skipper Third Party Liability policy comes into play is; if the yacht’s third party liability policy somehow fails to respond when a third party pursues a liability claim against you as the skipper of the yacht, or if you are uncertain as to the existence or suitability of the yacht’s third party liability insurance.

Is this a Professional Indemnity Policy?

I am a commercial skipper and i have been asked to deliver a yacht for a private client. i only need the insurance for 1 week. do you have a policy that will insure me, the crew and the yacht.

Unfortunately, we do not offer Professional Indemnity cover for delivery skippers, nor offer cover for short term risks or one off voyages and we do not have a policy that covers delivery skippers for loss or damage to a skippered yacht that they do not own.

Normal practice when a yacht owner uses a delivery skipper is that the yacht owner would have the delivery skipper approved by their insurers. In doing so, any loss or damage to the yacht whilst in the care of a delivery skipper would be paid for by the yacht owner’s hull insurers in the usual manner under the terms of the hull policy, as if the yacht owner had been on board at the time of the incident.

The yacht owner’s third party liability policy should likewise respond for third party liabilities incurred whilst the yacht is in the hands of a delivery skipper. Where the Pantaenius Skipper Third Party Liability policy comes into play is; if the yacht’s third party liability policy somehow fails to respond when a third party pursues a liability claim against you as the skipper of the yacht, or if you are uncertain as to the existence or suitability of the yacht’s third party liability insurance.  You might like to discuss with your prospective yacht owning client the possibility of having your delivery voyage covered under the owner’s yacht insurance in the customary manner.  However, purchasing the Pantaenius Skipper Third Party liability policy will provide an additional layer of personal protection and serve as a safety net should you personally incur a third party liability, whilst skippering, that is not covered by the yacht’s policies.

I am a commercial skipper and I use yachts that I do not own to conduct courses or undertake paid work such as deliveries or running charters. Can you insure me?

Yes, if you select the commercial use option the cover can be available to you, in accordance with the Terms and Conditions of the policy. Please read the policy details carefully to ensure you understand what the insurance is and what it covers.

If I take out a Commercial Skipper Liability Insurance would it cover me also for private use or would I need a Private Skipper Liability policy in addition?

The standard Skipper Liability insurance policy is for private use only and excludes commercial use, unless commercial use has been agreed by insurers.  The commercial Skipper Liability policy is an extension of the standard private use only policy, to also include commercial use. Private use is therefore included within the commercial policy and you do not need to buy two policies.

Why is a £50.00 administration fee charged for cancellations?

This is necessary in order to cover our costs in setting up and cancelling the insurance, so that it remains possible to continue to offer this insurance product in the future and at a competitive price.

Take advantage of our attractive deposit insurance for Skipper and Crew. It is easy to forget that a chartered yacht is not our own among the fun and freedom a cruise on dream waters evokes. Understandably, the yacht owner secures themself against unpleasant surprises and charges a deposit. Whether it's a sail breaking, the yacht gets a few scratches, or the slightest damage after your return from the dream vacation, the owner will partly or wholly retain this deposit. In this case, you are protected by charter deposit insurance.

Details for the charter deposit insurance

It is covered in the partial or total withholding of the charter deposit by the owner/charterer due to loss or damage caused by the private policyholder or the crew. Insurance benefit: The compensation of the damage in money does not exceed the insurance sum. The deductible is 10 % of the deposit, at least 100 EUR. If the regatta risk is included, the deductible is 15 % of the deposit, at least 300 EUR.

Simple pricing model

To determine the insurance premium for our charter deposit insurance, only two questions are necessary:

  • Is it covered for a voyage or an annual coverage?
  • How much is the deposit sum? (for an annual coverage the most expensive planned deposit sum)

We also charge a one-off policy fee of 15,00 EUR including the statutory insurance tax.

Sample calculation:

A voyage with a deposit of 2.750 € without regatta risk: 2.750,- € x 0,08 = 220,- € The insurance premium to be paid is 220,- €. If the regatta risk shall be included, the following calculation is valid: 2.750,- € x 0,08 x 1,15 = 253,- € A voyage with a deposit of 900 € without regatta risk: 900,- € x 0,08 = 72,- € The calculated premium is below the minimum premium. That's why the bonus is 75,- € .

How does the Excess Waiver work?

The Excess Waiver for a boat rental works in the same way as for a car rental.

The boat’s deductible is the amount below which the boat’s insurer will not pay. The rental company (and the yachtsman) are responsible for covering this amount in the event of a claim. The rental company passes on this amount in the boat’s security deposit. It’s important to understand that the amount of the boat’s deductible is often equal to the amount of the deposit, but not necessarily. A rental company may well ask for a deposit higher than the boat’s insurance deductible…

For example, a customer rents a boat for 3,500 euros, with an insurer’s estimated value of 200,000 euros and a deductible of 4,000 euros. The rental company may ask for a security deposit of 1,000 euros (for minor damage such as the loss of a winch crank, broken crockery, a lost fender, etc.) + 4,000 euros deductible, i.e. a total security deposit of 5,000 euros. It’s important to note that a residual deductible is often applied in the event of a claim. In fact, to raise awareness and encourage responsibility among charterers, even if the insurance reimburses the deductible in the event of damage, an amount of between €350 and €500 remains payable by the charterer.

Many rental companies still prefer to collect the security deposit together with the excess, even if you have taken out the excess waiver. In the event of a claim, the rental company will collect your deposit and your insurance will reimburse you for the excess. The maximum reimbursement amount is generally capped at 8,000 euros.

How much does the Excess Waiver cost?

The Excess Waiver costs between 4% and 8% of the rental amount. The price varies according to the sailing area (Europe or World) and the amount of the boat security deposit. Insurance policy fees are often added by the insurance broker (usually between €20 and €30).

What damages are covered in the event of a claim?

The Excess Waiver covers damage caused to the boat in case of a “sea event” , but in no way allows you to clear yourself of damage resulting from “minor breakage” for which you may be responsible and which remains your responsibility. The notion of ” sea event ” is important and must be clearly understood. A “sea event” is defined as a characterized accident resulting either from external impact of the ship, with a fixed or moving body, or from fire or explosion or natural force of exceptional and unforeseeable intensity, affecting the ship.

Why is the Excess Waiver sometimes mandatory?

Some charter companies require you to take out an Excess Waiver, particularly when chartering a boat with a professional skipper. In this case, the customer must also pay a reduced security deposit (between €500 and €1,000) to make him/her more responsible. It is the skipper and the rental company, not the customer, who bear the vessel’s excess.

What is deposit insurance?

A scuffed boat gelcoat, a clogged toilet, a submerged outboard motor, a broken or upended hatch — these are a just a few of the common reasons for losing your security deposit that you pay the charter company at check-in. The amount typically ranges from €500–5,000.

If no damage occurs during your sailing trip, you get your deposit money back, otherwise, the charter company deducts part or all of the deposit (depending on the amount of damage). Taking out deposit insurance ensures you don't lose your money. You can choose from two variants: the BASIC deposit insurance and EXTRA deposit insurance .

What is covered?

Partial or total loss of the deposit to the charterer as a result of destruction or damage to the chartered recreational vessel caused by the negligence of the insured skipper or crew.

Scope of insurance coverage also includes:

  • Dinghy including outboard motor
  • Basic sails (including careless handling, tearing due to sudden gusts of wind, etc.)
  • Loss or other damage to the winches

What is not covered?

The insurance does not cover (exclusions) damage caused:

  • Intentionally by the skipper or crew of the vessel
  • As a result of the use of alcohol, or narcotic or psychotropic substances
  • In connection with extraordinary events — e.g. war, mutiny, nationalisation, confiscation...
  • In the event of the vessel being captained by a person without the appropriate authorisation, evidenced by a generally recognised document of qualification (i.e. the vessel must not be sailed without an authorised captain)
  • When sailing in an area for which the vessel has not been approved
  • In the case of the vessel being in an unseaworthy condition, if it has already occurred and was apparent before departure
  • Unjustified withholding of the deposit as a result of an event not caused by the insured, the skipper or their crew
  • Any financial loss (e.g. seizure of the boat due to violation of laws, late return of the boat)
  • During races and regattas, including preparation for them — additional insurance may be taken out if necessary

Terms and Conditions of the Basic variant

  • Payment is subject to proven damage or destruction of the chartered vessel.
  • Proof of fault for the damage — the crew or skipper caused the damage.
  • The insurance covers only the crew and skipper with EU citizenship, regardless of their nationality.
  • The insurance does not cover areas of countries subject to current sanction restrictions  and does not cover damage caused by a person subject to sanction restrictions.

In case you book a boat in the Premium price package , which already includes BASIC deposit insurance, you will pay only the difference in the price of both insurances for the EXTRA variant.

Georgia Bill Requiring Boat Livery Insurance Waiting on Governor’s Signature

Boat operators, not properly insured boat rental places, will soon be held liable for injuries or damages caused by negligent operation of water craft if Georgia Gov. Brian Kemp signs a bill into law.

House Bill 994 was approved by the Georgia House and Senate in the final days of the legislature last month and it is now awaiting the governor’s signature. The law would take effect immediately upon signing and would shift liability from boat rental businesses, known as liveries, to drivers of the vessels – as long as the liveries maintain a hefty level of liability insurance.

A late change to the bill raised the insurance requirement from $250,000 per person and $500,000 in aggregate, to $500,000 and $1 million.

“In order to avail itself of the protections provided in subsection (b) of this Code section, a boat livery shall not rent, lease, or charter or offer to rent, lease, or charter a vessel without first obtaining and maintaining in full force and effect a policy from a licensed insurance carrier in this state or a nonadmitted insurer through a licensed surplus lines broker that provides coverage for such boat livery against any accident, loss, injury, property damage, or other casualty caused by or resulting from the operation of a boat livery vessel,” the bill reads.

The rental place would be held liable only if it fails to ensure that the boat operator is reasonably skilled in operating the craft and is not reckless, and that the boat is in safe condition. It also must have proof of insurance displayed and available for inspection.
